Constitutional Court (MK) declines a lawsuit filed by an activist, Paulus Agustinus Kafiar. The Verdict which registered upon number 33/PUU-XII/2014 was recited by Head of MK, Hamdan Zoelva on Wednesday (23/7) at MK Plenary Room.
In the Court’s opinion, recited by Justice Muhammad Alim, the Plaintiff was burdened by the “Bachelor or level” minimum regulation as determined in Article 12 letter c Act of Papua Special Autonomy (UU Otsus Papua). The Court sees that it is imporant the consider minimum bachelor level of education in importance of official recruitment in regional executive positons, non-exceptionally in Papua. The acceleration of development in Papua needs fundamenal thinking, established, comprehensive, and visionary, to which are imposed by high standard of educational level.
“With its specialized and varied problems, wrapped up with complicated development, physically and human resources. Papua needs visionaly and knowledgable executives, whose ability may help to think wisely to develop prosperity and strengthen Papua’s dignity in the Republic of Indonesia circumstance,” he said.
Alim also states that the educational requirement is applied equally for all Papuans who wanted to nominate themselves to sit in the Papua regional executive’s chairs. Furthermore, the regulation contained in the UU Otsus Papua can’t be treated equally as other regional laws determine.
The difference is not meant to discriminatively regulate due to the different specialized and characeristic problem of each regional has. The regulation was validated after Papua’s special concerns and necessity, to catch up with global realm and to accelerate its own development. (Lulu Anjarsari/mh/kun)
