Judicial Review Trial of State Civil Apparatus (UU ASN) which is pleaded by several Civil Servant (PNS), is held by MK, on Thursday (10/07). The agenda of the trial is revision checking for the cases which registered upon.

One of the applicants, Empi Muslion, explained to the Justices that he has revised the pleading as suggested by the Justice Assembly. To be exact, the change comprised legal standing and to sharpen the Applicant’s argumentation.  

According to him, the mandatory for PNS to resign from the office preceding to his/her registration for political position. Empi also said that both articles 119 and 123 verse (3) Act 5/2014 opposes the law certainty principle, because DPD membership is also a subject to that requirement.

To the revision, Constitutional Justice Patrialis Akbar said that the Plaintiff’s argument is optional. Not so many people have that opportunity to become a PNS, and the permanent status of the PNS is important to keep the state working.

According to the Court, the next Trial will be held after the cases deliberate on Justices’ meeting, and the plaintiffs are being asked to present expert. (Ilham/mh)
