Sentence Trial of nine parties’ pleadings over Maluku’s PHPU was conducted on Monday (30/6). Towards PKS’ pleadings, MK urges KPU to undergo recalculation in 18 Districts, South Halmahera region as well as in South Jailolo District, West Halmahera Region in accordance to PBB’s lawsuit.
PKS’ pleading is also likely to be granted, as MK instructs KPU to undergo recalculation over DPR RI candidate in 18 Districts.
According to the Court, uncertainty about voting result in 18 Districts in South Halmahera smears soundly. Although the Plaintiff has presented written and physical evidences, as well as three witnesses and the related has done likewise, none of them are able to convince the Justices.
Therefore, in order to gain certainty of all parties’ votes of which participated in South Halmahera Region and to protect voters’ rights, The Court adjudicates recalculation in those 18 Districts.
Meanwhile, for PBB’s pleadings, the Court nods to engineered invisible diversion as it was confirmed by the Head of Tabadamai Subdistrict, West Halmahera. Albeit, due to the diversion was done under uncertain circumstance and the exact number was failed to be revealed, it is barred to be granted. But, after considering factual events and law certainty, MK will still urge KPU to conduct the recalculation, although it has to be done by tackling any barrier.
“The Sentence, instructs West Halmahera’s KPU to conduct recalculation of DPRD Region in West Halmahera 1. At longest 10 days after the sentence being recited,” Hamdan Zoelva recited.
Meanwhile, to lawsuits of Golkar, Hanura, PKB, Gerindra and PPP, MK rejects all of them after nothing was proven to what they have objected.
Aside from it, Lawsuits of PD and PKPI were considered ineligible after deceiving and Obscuur libel pleas. (Nano Tresna Arfana/mh/kun)
