Constitutional Court drop a sentence for General Elections Committee (KPU) to conduct recalculate C1 Plano and to correct DA-1 recap in elevem sub-districts, Boyong Herangm Sukamaju, Babakan Karet, Sayang, Mekar Sati, Sawah Gede, Muka, Nagrak, Limbangan Sari, Pamoyanan, and Solok.

The sentence was dropped by the Court in the Sentence Trial of West Java PHPU on Thursday (26/6), at 23.16 in Hamdan Zoelva-led session.

In the sentence, The Court Adjudicated to annul KPU’s result of Hedi Permana Boy, individual applicant from Democratic Party, who pleaded for a seat of DPRD Province in Dapil West Java 3.

Upon the case registered under 10-07-12/PHPU-DPR-DPRD/XII/2014, the court found bolded numbers on the lists, which convey deceiving data. “Aside from it, indications of flattened and inflated votes for the three candidates are pretty sound. Therefore, to bear law certainty and justice the result needs to be recalculated,” the Court explained.   

In the Court’s consideration as been recited by the Justice Aswanto, the calculation is necessarily to take place and the correction needs to be advancing up to the DA-1 form in the namely sub-Districts. The instruction must be conducted by the KPU within 10 days at longest after sentence being dropped.

Rejected Pleadings

In its sentence, the Court rejects all PKPI’s pleadings of West Java Cases. The Applicant was considered has no intention to advance its pleading, as none of the given chances were used to prove its pleading, accordingly trial on date, 30 May, 3 June, and 4 June. “None of the given chances were attended by the Applicant, therefore the pleading will be considered unproven,” Justice Ahmad Fadlil said.

Apart from PKPI, other pleadings of Gerindra, Golkar, Hanura, Nasdem, PAN, and PDIP were rejected as well. Those pleadings were considered ineligible by the Court.

Unacceptable Pleadings

Toward numerous Pleadings of which filed by individual or parties, namely Gerindra, Golkar, PPP, PKB, Hanura, PAN, PDIP, and PBB. The Court decides to label unacceptable. In General, those lawsuits were rejected after of which lost its legal standing, registered after the due time, and was unable to describe what feud to be deliberated.

Revoked Applicants

In its pleading, the Court also received PD’s revocation of DPRD region feud in Dapil Cianjur 1. As well as Nasdem’s, Gerindra’s and PBB’s, the latter revoked its pleading of Tasikmalaya DPRD feud. (Ilham/mh)
