MK Instructs Recalculations in Several TPS in Samarinda

Constitutional Court (MK) instructs KPU to conduct recalculation of DPRD candidate in several TPS in Samarinda. MK also asks competent institution to monitor the occasion.

“Instructing General Elections Committee, Elections Monitoring Boards, and Elections Monitoring Committee to supervise recalculation of the elections to each competence accordingly,” Head of MK, Hamdan Zoelva said in East Kalimantan PHPU Sentence Trial deliberating PKS’ lawsuit on Thursday (26/6) in MK Plenary Session Room.

In his opinion, the Court sees that unmatched numbers of C1 forms and D1 forms disadvantaged the Applicant. MK affirmed that there was objection during the recap by the parties’ witnesses but it wasn’t directly respond by the committees (Defendant) which led to unclear exact result as the recap generated.  

Deep inspection of evidences, C1, D1, and C1 plano between the three related parties reveals many streaks and correction on the papers, exact results remain unclear while people’s votes might have been violated as well.   

“Therefore, according to the facts and legal consideration and to regain people’s trust, the Court instructs the Defendant to conduct recalculation for DPRD candidate in listed TPS below : TPS 1, 3, 5, , 8, 22, 27, 30, 34 Masjid sub-District; TPS 6, 22, 35 Baga sub-District; TPS 16, 29, 34 Sungai Keledang sub-District; TPS 4, 10, 13, 15, 18, 27 Rapak Dalam sub-District; TPS 20, 24 Harapan Baru sub-District; TPS 2, 5, 6, 10, 11 Sengkotek sub-District; TPS 4, 5, 7, 12, 20 Simpang Tiga sub-District; and TPS 10 Simpang Pasir sub-District, Palaran District, Samarinda,” Hamdan Zoelva said.

Meanwhile, towards pleadings of PKB, Golkar, Hanura, Democratic Party, and PKPI, the Court decides of which are unacceptable. “Applicant’s adjuration of Province DPRD candidates in East Kalimantan 1 Electoral Area is unfulfilling the Act’s requirements,” Judges explained in respond to Hanura’s pleading.  

Aside from it, the Court annulled lawsuits of Nasdem, Gerindra, and Hanura. The Court views their arguments are unproven.(Panji Erawan/mh/kun)
