Sentence trial of several parties’ lawsuits for PHPU in West Nusa Tenggara was held by Constitutional Court on Wednesday (25/6). MK declines pleadings filed by National Democratic Party (Nasdem), Function Group Party (Golkar), Crescent Star Party (PBB), People’s Conscience Party (Hanura) and Justice Prosperous Party (PKS). Meanwhile, others pleadings filed by National Awakening Party (PKB), Greater Indonesia Movement (Gerindra), Democratic Party (PD), and United Development Party (PPP) are considered unacceptable.
Nasdem’s pleading was forfeited after The Court views that its arguments were entirely debunked by KPU’s evidences. It was proven that there was no protest during the recap in East Lombok and all parties signed the recap documents to validate the unanimously agreed elections recap.
Aside from the written evidences, the Plaintiffs also presented several witnesses, but none of the testimonies were convincing enough to prop the Plaintiffs’ arguments. Thus, the Court rejects the plaintiffs’ exceptions. “The Sentence. Considering and deciding. Decline Plaintiff’s pleading. In the foremost point, decline the pleading, entirely,” Head of MK, Hamdan Zoelva recited.
Toward Golkar’s pleading, the Court views that ignorance of NTB Bawaslu’s recommendation to revise recap certificate has nothing to do with lawsuits’ objection. Meanwhile, on disputed votes margin feud in Bima, the Defendant reportedly had Bawaslu’s recommendation undergone, but it was conducted overtime as sub-district Mande TPS 4 had decided. Furthermore, two presented witnesses have no reliable testimonies to strengthen the argument. Hence, the rejection.
For Hanura, the Court rejects its lawsuits entirely, since the registered evidences are unproven on legal basis, while the witnesses’ testimonies did not cite any wider perspective.
Over the Due Time
PKB’s lawsuits were rejected as well, as it was registered on Thursday (15/4), days after the due date, which respectively closed 3 days after KPU announced the official result. PHPU cases of DPRD candidates for Dapil Central Lombok (individual upon Sadariah, S. Ag) was rejected due to the belated registration.
No Wrtten Agreement
Dems’ pleading for West Nusa Tenggara 7 DPRD candidate on behalf of Himni S.Pd was also rejected.
The pleading didn’t meet the requirement, since it wasn’t signed by PD officials as being regulated on Article 2 verse (1) letter b PMK 1-3/2014. In Court’s view, the pleading lost its legal standing and rejected without considering exception, due date, and pleading’s points. (Nano Tresna Arfana/mh)
