Constitutional Courts (MK) imposes sentence on numerous pleadings over Disputed Elections Result (PHPU). All DPR, DPD, and DPRD city/regional interval sentences were recited on Wednesday (28/5), at MK Plenary Room.  

In Hamdan Zoelva-led hearing, MK decided to discontinue some pleadings’ process of PHPU. Both Parties and individual feud, whose applications being pulled off and failed to meet the requirement will be completely removed from the ongoing trial as implied in the regulation (Article 31, 35, 74 and 75 of MK Act and MK’s Guidance of DPR, DPD, and DPRD PHPU Hearing.  

Below are some dapil (Election Regions), which, according to MK’s Sentence, are disallowed to proceed on PHPU trial. Split on each party.

1.National Democratic Party (Nasdem)

Nasdem dispatched is pleadings for a DPR RI case, West Java VIII. For DPRD province, dapil Papua 1, Papua 5, and Papua 6. DPRD  region/city Mimika 2, Intan Jaya 2, and Langsa 3.

2.National Awakening Party (PKB)

PKB’ applications didn’t get through the verification for DPR RI cases, South Sumatera 1 and Bengkulu 1.

For DPRD province, Dapil Banten 1, East Nusa Tenggara 7, Central Sulawesi 1, and Papua 3.

For DPRD city/region, Dapil Batu Bara 1, Sidoarjo 4, Luwu 3 and 4, Kapuas 1, and Central Lombok 6.

3.Justice Prosperous Party (PKS)

PKS’ pleading that won’t be proceeding for DPRD region/city is Dapil Samarinda 5.

4.Function Group Party (Golkar)

For Golkar, discontinued pleadings will be Dapil Jambi 1 and Papua 1 for DPR RI.

DPRD province are DKI Jakarta 10, East Kalimantan 4, South Sulawesi 4 and 11, and Papua 1, 2 and 7.

While DPRD region/city cases from, Mesuji 4, South Buru, Puncak 2, Jayapura 1 and 3, Mimika 1, 3, and 5, Pegunungan Bintang 1 and 2.

5.Greater Indonesia Movement Party (Gerindra)

Gerindra pulled off one case of DPRD regional/city, namely Dapil Siak 1 in Riau.

 Disqualified pleadings for DPR RI case are, Aceh 1, North Sumatera 2, West Java 5, East Java 2, and Papua 1.

For DPRD province, Dapil Aceh 5, Riau Islands 1, Lampung 8, East Nusa Tenggara 4, Papua 2, 3, 4, 5 and 6. 

For DPRD region/city, Pidie 4, North Aceh 2, 4, 5, North Tapanuli 1, Siak 1, Bandar Lampung 6, Metro 4, and Mimika 1. 

6.Democratic Party (PD)

PD pleadings which didn’t meet the requirement for DPR RI, namely North Sumatera 1, Lampung 2, East Java I, and South Sulawesi 3.

 For DPRD province, Dapil North Sumatera 3 and West Nusa Tenggara 7  

Meanwhile for the DPRD region/city, Dapil Binjai 3, Simalungun 1, Banyuasin 4, Kutai Timur 5, Berau 3, Buru 3, Makassar 5, and Tolikara 3.  

7. United Development Party (PPP)

Three pleadings of disputed elections were pulled off by PPP. Namely, Dapil Jakarta 8 for DPRD province, Dapil Tangerang 3 and Tegal 3 for DPRD regional/city.  

Disqualified pleadings for DPR RI are Dapil Jakarta 1 and West Nusa Tenggara 1.

For DPRD province, South Sumatea 8, Banten 4, West Kalimantan 1, and North Sulawesi 1.

For DPRD region/city: Deli Serdang 3, Agam 1, Palembang 3, Bekasi 5, Cianjur 1, Tangerang 3, Tegal 3, Bima 1, Pontianak 3, Malawi 1, Manado 3, Gowa 5, Bau Bau 3, Nabire 2.

8. Crescent Star Party (PBB) 

PBB decided to dispatch one pleading of DPRD region/city case, Dapil Pidie Jaya 3. Meanwhile, half of its pleading will be disqualified due to the Court’s regulation. 

For DPR RI, Dapil Aceh 1, North Sumatera 1, West Sumatera 1, Jambi 1, South Sumatera 1 and 2; Bangka Belitung 1, Lampung 1 and 2; West Java 3, 6, 7, and 9; Banten 1, Central Java 3 and 7; East Java 1, 2 and, 9; West Nusa Tenggara 1, East Nusa Tenggara 2, West Kalimantan 1, South Kalimantan 1 and 2; North Sulawesi 1, South Sulawesi 2 and 3; West Sulawesi 1, and North Maluku 1.

 

For DPRD province, West Sulawesi 1 and 3, Maluku 4, and Papua 5.

Meanwhile, for the DPRD region/city, Way Kanan 1, Tasikmalaya 1, Garut 1, 2, 3, 4; West Bandung 2, Bekasi 3, Cimahi 1, Pasuruan 1, 2, 3, 4, and 5; Lembata 2 and 3; Kolaka 3, Polewali Mandar 4, South Halmahera 3, and Mimika 1.

9. Indonesian Unity and Justice Party (PKPI)

Disqualified PKPI pleadings are Medan 3, Simalungun 1, Sula 3, Jayapura 1, and Nabire 2. All of them are dapil of DPRD region/city.

10.   Indonesian Democratic Party of Struggle (PDIP)

PDIP pulled off one DPR RI case from Dapil Jateng V. Another one case won’t be proceeding is DPRD province case from South Sulawesi 5, due to its failure to qualify MK’s requirement.

11.  National Mandate Party (PAN)

PAN pulled off two pleadings over DPRD region/city, Cimahi 5 and Buru Island 3.

Disqualified pleadings for DPRD province namely, West Java 4, DKI Jakarta 4, 5, and 9; East Nusa Tenggara 2, Maluku 6, Papua 3, 4, 5, and 6.  

Moreover, for DPRD region/city, Nias 1, Sarolangun 3, Pesawaran 3 and 4; and South Tangerang 6.  

 12.  People’s Conscience Party (Hanura)

Hanura pulled off a DPRD province case in South Sumatera 8.

Meanwhile disqualified applications for DPR RI are North Sumatera 2, West Java 7, Central Java 1, East Java 8, and West Nusa Tenggara 1.  

For DPRD province, North Sumatera 1, 3, and 8; South Sumatera 1, 2, 3, 7, and 8; West Java 9. Nusa Tenggara 6, East Kalimantan 1, North Sulawesi 1, and Papua 7. 

For DPRD region, Dapil Medan 3, Asahan 2, Mentawai, Musi Rawas 1, South Lampung, Cianjur 5, East Flores 1, Balangan 1, North Sulawesi 6, Minahasa 1 and 3, Makassar 3, Toraja 6, Buru 3 and East Seram 1.  

 DPD Candidates

Aside from deciding over Political Parties’ pleadings, the court will also decide over DPD candidates. The Court confirmed several pulled-off applications, namely Amri Mustafa and Maksum Dai from West Sumatera. While, La Ode Sabri’s from Southeast Sulawesi and Nono Sampono’s leadings won’t be proceeding due their failure to qualify.
