Pleading not Proven, MK Rejects Application on Lampung PHPU

Constitutional Court (MK) rejects all Hi. Herman HN-Zainuddin Hasan’s pleading. As verdict no.8/PHPU.D-XIII/2014 has been decided. The verdict was recited by Head of MK, Hamdan Zoelva on Wednesday (14/5) in MK Plenary Hearing Room. “Told in exception, declines all of applicants’ exception” Hamdan said

In Court’s views, recited by Deputy Head of MK Arief Hidayat, there is no evidence on fudges of schedule and data. List of Permanent Voters (DPT) is not just Applicant’s obligation, but also local government’s duty to provide demographic data, and local surveillance’s role to supervise voters listing.

In this DPT fraud, MK sees no convincing evidence about actual fake voters or missing ballots. The moved votes also can’t be assured since the data is not enough to convince the Justices. “The Applicant’s pleading is a quo with no legal standing” Arief said.   

On other fudges, presumably done by M.Ricardo Ficardo-Bachtiar Basri, MK decides the accusation is not proven.”Therefore, the plead is a quo with no legal standing” Arief added

On other fudges, Applicant’s pleads is not backed with convincing evidences. Thus, the accusation whether the fudge led to systematic, massive, and significantly invert the election’s result can’t be proven. “Regarding all of our descriptions, we view the pleading is illegitimate” he said.
