Agenda of the session time is to listen to the expert testimony submitted by the applicant to prove the petition, namely constitutional law expert Hamid Chalid and Irman putra Sidin and Economics expert Salamuddin Daeng.

According to Hamid Chalid, granting rights to water management in private enterprises showed the weakness of the state in managing water resources and may endanger the public in fulfilling their rights to water to sustain life.

While Irman putra Sidin judges Court interpretation of Article 33 UUD 1945 were made ​​by the applicant touchstone to test a number of articles of the Law on Water Resources is growing. Irma argues , in this time of testing interpretation of state control of the natural resources of the Constitutional Court shall be construed as natural resource management directly by the state . According to Irman, the Act should not limit the state’s control over the water. The control directly by the state is the most constitutional way in the context of current developments to be used as much as possible for the welfare of the people.

In line with the second expert, Salamuddin Daeng said that the state’s control of the water should absolutely be in the hands of the state to a prosperous society. Third Expert applicant also revealed the same thing, that the Water Resources Law was published because of pressure from the World Bank to Indonesia as a condition of disbursement of the loan funds to Indonesia.

The next hearing will resume on Wednesday, February 12, 2014 to hear the House of Representatives (DPR), the expert proposed by the government , and the Water Resources Board. (Ilham/ mh )
