The Constitutional Court (MK) received a visit from students and faculty at the Law School (STH) is accompanied by Chairman of STH Garut, Itjeu Fatimah, on Monday (13/1) in the morning. In theory Sovereignty of God, the highest authority in the state comes from God . That is , the king or the ruler of the country gets the ultimate power of God so that the will of the king or ruler is also the will of God . While in theory the Sovereignty of the King, a king assured the people that there is the highest authority of the king.
“The power is so absolute was subsequently reduced bit by bit, and then emerged a new theory. For example, the People’s Sovereignty theory explains that every human being is born has its own sovereignty, not granted by the king or whoever," said Ghoffar.
Furthermore, Sovereignty of the People’s theory raises new theories, such as the Social Contract Theory. This theory is the most relevant theory to explain an idealized state can be formed. Social Contract Theory is an agreement between the people and their leaders, the men who are members of a particular community.
“Indonesia has been using Social Contract Theory, because that makes the Constitution instead of the whole people of Indonesia but only astute scholar who did it. Such as Bung Hatta, Bung Syahrir, Bung Karno and others," said Ghoffar.
Democratic leader
Ghoffar further expressed concern that prior to 1998; Indonesia has not found a leader of a democratic, fair and authoritative. He cited the leadership of Sukarno. In the early days of his leadership, Bung Karno was known to be very fair. “But towards the end of his term, Sukarno issued a policy of democracy in one command. That is, all the power in a single command. He educates himself into an authoritarian leader," added Ghoffar.
Soeharto, as the new President of the Republic of Indonesia around the year 1965-1968, he was known as a highly democratic. “At that time he was hailed by the students because of his democratic. Students push to lead Soeharto Indonesia," said Ghoffar.
