Court Set Overall Vote Results after Maluku Governor Re-Election

Said Assagaff – Zeth Sahuburua and Abdullah Vanath - Martin Jonas Maspaitella won the first and second most votes after Maluku Election Commission implement interlocutory decision of the Constitutional Court in a final verdict case number 94/PHPU.D-XI/2013, Thursday (14 / 11/2013) at the Plenary Room. Court verdict set the voting results of the seven candidates in re-election at all polling stations in the district of SBT, with the acquisition of Abdullah Vanath - Martin Jonas Maspaitella get 52,819 votes and Said Assagaff- ZethSahuburua with the acquisition of 10,914 votes. In addition to the two candidates, the Court also set three other candidates.

Constitutional Court in its consideration saidthat the Commission has been carrying out re-election at all polling stations in the SBT on September 11, 2013. "As the Commission report Maluku Province On Re- Election Ballot Governor and Vice- Governor of the Province of Maluku in 2013 in East Seram District dated 24 September 2013 received by Registrar of the Court on September 27, 2013," said the judges.

Court argued, the applicant submit a written objection to the District SBT re-election results and verbally, to Related Party I and II, the Court considered that the re-voting has been done well and smoothly, although there are some reports of violations of the Election and Petitioner’s objections related issue final voters list in District of SBT, the mobilization of voters from outside District SBT, and the involvement of bureaucracy and civil servants SBT District Candidate certain to win.

Because there is no evidence of violations that significantly affect the implementation of re-election and influence voting results of the candidates in the PSU at all polling stations in the district of Maluku province SBT on Election Year 2013 the Petitioners’ objection is not unreasonable under the law. " Thus, the Court Voting Re in all polling stations in the district of East Seram in Maluku Province in 2013 General Election which was held on 11 September 2013 has been carried out in accordance with the Decision of the Respondent ( pause) No. 94/PHPU.D-XI/2013 Court , dated July 30, 2013 and in accordance with the legislation," said the Court.

In addition to the above case, the case number 91/PHPU.D-XI/2013 filed by Abdullah Tuasikal - Hendrik Lewerissa, the ruling in the Constitutional Court rejected his petition.
