Questioning Nomination Requirement until Intimidation, Zahir-Suriono Sues Batubara District Election

Candidate Regent and Vice Regent Batubara District Number 5 Zahir - Suriono sued to the Constitutional Court. Case Number 144/PHPU.D-XI/2013 preliminary hearing was held on Wednesday (16/10) afternoon, at the Plenary Room. Attorney Zahir - Suriono, Ikhwaluddin Simatupang, revealed that the applicant objects to Batubara District Election Commission (Respondent) who won the Candidate Number 6 OK Arya Zulkarnain - Harry Nugroho (Related Parties). According to him, Batubara Election administration has violated the principles of the election.

"If the District Election Coal conducted honestly, fairly, direct, general, free, secret, then the applicant is the first winner winning the most votes in the Electoral District of Batubara," said Ikhwaluddin.

Ikhwaluddin accused the Respondent and the Related Parties have committed a breach and fraud during the General Election. Some of these violations include money ranging from politics, the mobilization of civil servants (PNS), intimidation, alignments Respondent to Related Parties, to the non-fulfillment of requirements as a candidate for the head area by Arya Zulkarnain.

"The offense carried out in a structured , systematic and massive by the Respondent to the ranks to the bottom, including the Ballot Group Organizer (KPPS) and also Candidate incumbent OK Arya Zulkarnain who have used the structure and administration facility in Batubara County to undertake efforts to gets the most votes," said Ikhwaluddin.

According to Ikhwaluddin, when referring to the earlier decisions of the Court, then the violations disclosed by the company, may be the basis for the Court to annul the results of the General Election that has been set by the Respondent. Therefore, there is a lot of discrepancy in terms of education documents used by Arya when registering as a candidate for the head area.

"Respondent says Candidate Number 6 qualified education, whereas H. OK Arya Zulkarnain as Candidate does not meet diploma elementary, junior high school, and senior high school," he said.

 After listening to the main points of the petition, the Constitutional Court Panel led by Deputy Chief Justice Hamdan Zoelva then set a schedule for the next hearing on Friday (18/10) morning, with the agenda to hear an answer from Respondent, Related Party, and examine applicant witnesses.
