Eight of the Constitutional Court justices held a closed meeting on Saturday (5/10) evening addressing a related development the case of the Chairman of the Constitutional Court non - active, M Akil Mochtar. After a meeting that lasted until Sunday (6/10) morning at the Constitutional Court building, the Deputy Chief Justice Hamdan Zoelva told the media in a press conference with 7 other constitutional judges said that M. Akil Mochtar , has submitted his resignation as a constitutional judge. During the event, Hamdan also said the agreement Constitutional Court Plenary Meeting that was held for nearly 6 hours.
In a statement read by Hamdan Zoelva, Court understand the response and good intentions of President Susilo Bambang Yudhoyono, who has collected the heads of state agencies to find solutions for the events that occurred in M. Akil Mochtar that affect the image and prestige of the Court.
But Hamdan said the leader should invited Constitutional Court on the meeting to also express their views and participate together the head of the other countries in order to find the best solution. Hamdan said the eight judges existing constitution felt as if were responsible in case Akil Mochtar, thus causing the President did not invite MK leadership element. With such treatment, the Court was treated as an object, but the 1945 Constitution put the Constitutional Court as well as state agencies.
Hamdan explained, the Court realized the anger and frustration of the people on the events that happened to M. Akil Mochtar, and Court conveyed petition to apologize profusely for the incident on the community. The Court handed the matter entirely in the legal process.
As for the opinions and responses related to the case of Akil Mochtar, Hamdan asserted, the events that happened to Akil Mochtar did not interfere with the validity of the decision of the Constitutional Court. According to the Court, the problem faced by Akil Mochtar is a law event that is personal is personal responsibility, not an issue the Court as an institution.
The statement was signed by eight constitutional judges that Hamdan Zoelva as Vice Chairman and member, Ahmad Fadlil Sumadi, Anwar Usman, Arief Hidayat, Harjono, Maria Farida Indrati, Muhammad Alim, and Patrialis Akbar respectively as members. ( Ilham )
