Three petitions of Probolinggo Regent Candidates Denied

Constitutional Court decided to reject all requests of Probolinggo Election Dispute 2013, which was read by Chief Justice M. Akil Mochtar, accompanied by eight other constitutional judges, in Courtroom on Wednesday (25/09). "Verdict stating rejected the petition in its entirety," said Akil Mochtar.

The petition filed recorded three candidates, candidate number 1 Dewi Ratih - As’ad Ansari ( Deras ) that is registered with number 105/PHPU.D-XI/2013, candidate number 3 Zulkifli Khalik – Maksum Subani registered number 106/PHPU.D-XI/2013 and candidate number 4 Hadi Zainal Abidin - Kusnan , with case number 107/PHPU.D-XI/2013.

Zulkifli Khalik – Maksum Subani argued violations by Probolinggo Election Commission. Fraud committed by candidate number 2 Rukmini - Suhadak with abuse of authority as the mayor’s wife, and a lot of politics going on in each district money by distributing groceries to residents with to choose his destination.

According to the Court, the argument does not prove fit enough convincing evidence that the offense is structured, systematic and massive to the detriment of other candidates. Therefore, the argument was not proven according to law.

The applicant Zulkifli Khalik – Maksum Subani stated Probolinggo Election Commission alignments to candidate number 2 , in which the Commission passed a candidate number 2 Rukmini who do not pass the medical tests , because due to his cancer illness. According to the Court, the applicant cannot or do not present evidence and witnesses to strengthen and assure the judge constitution.

Petitioner also argued that as the organizer of the Respondent had acted unprofessionally election. The lack of professionalism by printing and distributing paper ballots to polling stations than the maximum number of ballots they should, to the destruction of ballot boxes and seals the opening of the ballot boxes in PPS Mayangan Village, Sub District Mayangan. According to the court, so the argument is not based on sufficient evidence and that number did not significantly affect the vote applicant to exceed the Related Parties votes. Therefore, Petitioner’s argument that no legal grounds.

Furthermore, Petitioner Hadi Zainal Abidin - Kusnan argued Respondent has committed violations, the existence of double voting as many as 672 voters, DPT is related to unauthorized Population Identification Number (NIK) of 46.947 voters, the people who have died or who have moved residence but is still enrolled in the DPT as much as 1.243 voters, there is a correction of RT / RW as many as 480 voters. According to the court, so there is no argument convincing evidence.

Petitioner’s argument against the existence of other violations had not been evidenced by a fairly convincing evidence about the offense is structured, systematic and massive to the detriment of other candidates. ( Panji Erawan / mh )
