The trial on dispute election of regional head of Southwest Sumba District was held back by the Constitutional Court, on Thursday (22/8) afternoon, at Plenary Room. Constitutional Court Panel headed by Chief Justice M. Akil Mochtar had listened to testimony of ten witnesses presented by the Related Party, Candidate Number 3 Markus Dairo Talu-Ndara Tanggu Kaha.
Witnesses presented by the Related Parties in the event largely Election organizers. In fact, one of the commissioners of District Election Commission of Southwest Sumba, Petrus B Walu, also gave testimony to Related Parties.
As a Member of the Commission, Petrus was in charge of Division of Socialization and also acted as Chairman of the Labor faction of the Voting Committee at District Level. In his statement he justified that at the district level recapitulation is no objection from the witness Candidate Number Two Kornelius Kodi Mete-Daud Lende Umbu Moto (Applicant). "The objection of the witness spouse number two, the reason for different results," he said.
However, he said, when the witness is unable to show documents or summary form the CO level to do the comparison. According to him, the witness had been simply basing his objection on the record only, not attachments recapitulation of the Commission. Thus, the Southwest Sumba Commission (Respondent) suggested witnesses to fill out a form and recapitulation continued objection. The recapitulation of the witness in question is the result of a recap on Central Wewewa District and Western Wewewa District.
Witness Manase Lende Louro as District Election Committee Chairman Central Wewewa justified it. According to him, it is true witnesses of object number 2. Figure in question is the result of the vote in the Village Enggaba. Because according to witnesses there was the addition of votes for each candidate.
"I call witness number two, I’m attachments D1. He does not show the time. Because at the rate of PPS did not participate recap. No D1 attachments and so I said objections submitted in writing," said Manase.
Manase also asserted that there was no manipulation of sound at the recapitulation of the vote for each candidate. "There is no graffiti. Not true (no difference)," he said. "At the district level there is no change. Number has been equal."
Even thought, at that time there was no record of Supervisory Committee. "All PPK signature, numbered only three witnesses. Supervisory Committee no recommendation," he said. This testimony is justified by one of Central Wewewa PPK Member, Agustinus Umbu.
When the summary was, he said, has also been attended by Chief of Police of West Wewewa, Head Sub district Wewewa West, District Supervisory Committee, and Chairman of the PPS of 17 whole villages.
After hearing the testimony of witnesses, Akil Mochtar was then scheduled the next hearing to re-examine the witnesses Petitioner and the Related Parties. The next hearing will be held on Monday (26/8) afternoon. The plan will be the examination of witnesses Petitioner ten, ten witnesses Related Party, and Supervisory Committee heard testimony.
