Constitutional Court rejected Election Dispute of Padang Panjang City filed by four candidates for Mayor and Deputy Mayor, which Yusyafnital-Yuheldi, Sonny Idroes-Aldias Sastra, Edwin-Eko Furqani and Jon Enardi-Yurnalisman who refused determination of Hendri Arnis-Mawardi as selected candidate. Constitutional Court’s decision was based on findings of fact the trial is judged to be sufficient to convince the judges that there has been a violation of a structured, systematic and massive that the Commission can overturn of Padang Panjang City.
As in the argument, deliberately letting the local election ballot is damaged, the suspect can be misused to support the award of the Related Party Hendri-Mawardi, the Court argued, there is no intent or bad faith abuse of the Commission for the spoiled ballots. Commission in its response in the evidentiary hearing also claimed to have done all the procedures according to applicable regulations. Petitioners’ arguments had no legal ground.
Similarly, allegation of money politics was presented by the Petitioners. The Court did not find any concrete set of facts that could convince the judges that the money political activities significantly affect the vote each candidate. Therefore, the argument was not unreasonable under the law.
"Rejecting the petition of the applicant in its entirety," said Akil Mochtar.
The Constitutional Court upheld the decision of Padang Panjang City Commission which set Hendri Arnis-Mawardi as Mayor and Deputy Mayor period 2013-2018. (Julie / mh)
