The Constitutional Court (MK) rejected entirely an application for dispute Election results in North Maluku province on Thursday (1/8). Decision No. 97/PHPU.D-XI/2013, 98/PHPU.D-XI/2013, 99/PHPU.D-XI/2013 and 100/PHPU.D-XI/2013 was read by Chief Justice M. Akil Mochtar, accompanied by seven constitutional judges.
"Declare rejected the petition in its entirety," said Akil at Plenary Room.
The Court expressed Petitioners’ argument unreasonable. The Petitioners argue that the practice of money politics conducted by Candidate Number 3 Abdul Gani Kasuba-Natsir Thaib, counting errors and partiality conducted by the Election Commission of North Maluku province, and others. The Court did not consider the other evidence and witness testimony presented by both the Petitioner, Respondent, and Related Party unless the evidence and witness statements that have been considered above, because of the evidence and testimony of the witnesses is another testimony or new information beyond arguments the arguments contained in the petition improvement so irrelevant to prove the theorem petition.
"The Court has received and read and check Election Supervisory Board Written Statement of North Maluku province and its Attachment which some information is essentially the same as the arguments presented by the Petitioner are based on consideration of the Court to the arguments above, it is evident that none of the Petitioners’ argument that proved according to law," explained Judge Maria Farida Indrati.
Moreover, the Court does not prove that the Respondent and the Related Parties have made violations a structured, systematic and massive that significantly influence the ranking of votes each Candidate. "Therefore, all Petitioners’ a quo has not been proven according to law," she said.
Petition was filed from four different applicants, namely Muhadjir Albaar-Sahrin Hamid (Case No. 97/PHPU.D-XI/2013), Ahmad Hidayat-Hasan Doa (98/PHPU.D-XI/2013), Syamsir Andili-Benny Laos (99/PHPU.D-XI/2013), and Hein Namotemo-Abdul Malik Ibrahim (100/PHPU.D-XI/2013). (Lulu Anjarsari / mh)
