Nagekeo Regency Election Lawsuit Denied Overall

After looking at the facts and evidence in the trial, the Constitutional Court (MK) has finally decided to reject all requests in dispute of election result of Nagekeo Regency - Case No. 101/PHPU.D-XI/2013. Thus was the decision of the Constitutional Court which pronounced on Wednesday (31/7) afternoon at the Plenary Room.

Court did find the fact there is an attachment model of DA1-KWK Commission for Mauponggo District, Boawae District, and Wolowae District written "Candidate Number and Name of the Governor and Deputy Governor". Nevertheless, the substance of the contents of the columns I have written the names of candidates for Nagekeo Regency Election 2013, according to the serial number along with the vote of each candidate. So that the error did not affect all candidates’ vote.

Similarly, the Court also found no evidence to convince the Court that there is some form C1-KWK Election Commission that there is writing the Governor and the Deputy Governor and filling out the form also does not use blue, green, or purple ink. Based on the facts of the law, according to the Court, the Petitioners’ arguments are not unreasonable under the law.

Respondent (Nagekeo Election Commission) also recognizes there are typographical errors on a form BC-KWK KPU which embosses Sikka Regency in the signature column of the members of the Commission, which should be written Nagekeo Regency. According to the Court, the error does not correct administratively, but cannot be sure it has an effect on voters.

However, the Court considered that the administrative error deserves sanction of the authorities.

Based on these considerations, the Court reasoned arguments of the applicant are not in accordance with law. "The ruling states rejected the petition of the applicant in its entirety," M. Akil Mochtar said that. He was accompanied by other constitutional judges.
