Incumbent Regent-Deputy Regent of Southeast Maluku, Anderias Rentanubun-Yunus Serang (Ayu) had intimidated a number of Civil Servants (PNS) to support them in Southeast Maluku regency election. Thus confirmed by Yuhsril Ihza Mahendra, attorney candidate number 3 (three), Thaher Hanubun-Gerry Habel Hakubun, the applicant in case 95/PHPU.D-XI/2013 on Monday (22/07 / 2013).

Yusril further explained to the panel of judges led by Chief Justice M Akil Mochtar, besides mobilizing the incumbent civil servants are also considered to have weakened the functions and duties of the Election Supervisory Committee (Panwaslu) in overseeing the disbursement of funds by inhibiting operational Supervisory Committee of Southeast Maluku.

In addition, the Petitioner also alleged that the General Election Commission (KPU) Southeast Maluku has intentionally to impede Petitioner and the parties to contest the election results to the Constitutional Court to assign candidates elected 7 days after the determination of the official report the results of recapitulation. Yusril argued, in terms of legislation, establishment candidates elected Commission issued no later than one day after the determination of the minutes of recapitulation. On this issue Yusril asked the judges to give judgment.

Petitioner’s argument regarding intimidation and mobilization of civil servants incumbent to win was denied by couple Ayu, incumbent Regent-Vice Regent. According to the legal team representing the couple’s argument against the intimidation of civil servants to support the incumbent is not true. Additionally, Cosmas E. Refra, one attorney of Related Party should assess the applicant in filing refers to recapitulation news event, rather than the determination of the candidate elected by the Election Commission of Southeast Maluku, thus the applicant should request was rejected by the constitutional judges.
