The Constitutional Court rejected lawsuits Candidate Regent and Vice Regent Ogan Komering Ilir (OKI) Number Three Zaitun Mawardi Yahya-Herman Thalib. Decision Number 70/PHPU.D-XI/2013 is pronounced in the plenary session on Monday (8/7) at the Plenary Court. "Principal application is not proven and no legal ground," said Chief Justice M. Akil Mochtar.
Based on the evidence and legal facts revealed in the trial, according to Constitutional Court Justice Anwar Usman, the Petitioner’s arguments are not proven according to law. "The violations argued by the Petitioner, if any, are not structured, systematic, and massive, which significantly affect the ranking of the results of the vote each candidate but only sporadic."
Therefore, Anwar said, overall the facts disclosed by the applicant cannot undo the results of the General Election in whole or in part, because it is not significant to the outcome of the vote each candidate. "Even so, the violations cannot change the outcome of the General Election still be followed up through the civil court process," he said.
Previously, the applicant revealed several violations and fraud committed by both the Election Commission OKI (Respondent) and Candidate Number 4 Iskandar - Muhammad Rifai (Related Parties). Applicant argues that the occurrence of such confusion made by the Respondent in all polling stations in the form of lack of ballots, mark / noise reduction for candidates by the Respondent, as well as the practice of money politics and mobilization of government officials to win the Related Parties.
