All teachers in Congress Subject Teacher (MGMPs) of Citizenship Education as Cirebon regency visit to the Constitutional Court (MK) on Friday (5/7) morning. Their arrival was received by the Court Researcher Fajar Laksono Soeroso on the 4th floor. On that occasion, various matters relating to the performance of the Court explained by Fajar.
One of them, Fajar described the authority and obligation of the Court. "Judicial review, the authority to decide disputes between state institutions and the authority granted by the Constitution, dissolution of political parties," Fajar said on that occasion.
The next Court authority, Fajar continued, decide disputes and dispute election results elections of regional heads. "In deciding disputes over election results, the Court did not simply become ‘Court Calculate’. That is, not only to hear the numbers of election results. But then the Court also prosecute the election process, that the election outcome is affected by the process," said Fajar.
"If the electoral process is bad and undemocratic, it can be ascertained the results are anything but democratic. So the Court also entered into the realm of the election process, because as the guardian of the constitution and the guardian of democracy," added Fajar.
Related to that, then there is a violation called with structured, systematic and massive gains that could alter the results of the General Election.
Fajar continued, Election East Java several years ago became jurisprudence of the Constitutional Court when deciding disputes over the results of the General Election. Because in the East Java General Election, the Court decided that the decision is not set in the previous Act.
"At that time the Court ordered the Election Commission decided to East Java held a re-voting in the two districts, Sampang and Sumenep. It was including the re-counting of votes in Pamekasan. This was done the Constitutional Court because the areas suspected violations occurred which has damaged democracy," explained Fajar.
In addition to having four authorities, said Dawn, the Court has a duty related to the impeachment of President or Vice President. President could be impeached if it violates the Constitution or a criminal offense.
"For example, if the President of the House of Representatives suspected of committing corruption, then submitted to the Court. The Court will next hear, and then call the President and Parliament to prove these allegations. If it is not proven, it is finished. But if proved, the Court can not necessarily bring down a President or Vice President, as the Court does not have authority to impose the President or Vice President, "said Dawn.
However, the decision on the alleged violation by the President or the Vice-President was returned to the House and then invite the Assembly as an institution that decides a President or Vice President impeached or not. (Nano Tresna Arfana / mh)
