Court States Sarimuda-Nelly Rasdiana Objection Cannot be Registered

The Constitutional Court held a hearing in the matter of pronunciation provisions Number 42/PHPU.D-XI/2013 concerning Dispute of Election Result of Palembang City Election, Tuesday (18/6) at the Plenary Court. In the writ, the Court stated objection and cancellation petition filed by Candidate Sarimuda - Nelly Rasdiana toward Palembang Election Commission’s Decree No. 37/Kpts/KPU.Kota-006.435501/2013 cannot be recorded in the registration book constitutional cases. 

"Ordered Registrar of the Constitutional Court to issue a certificate stating that the application was not registered in Constitutional Cases Registration Book accompanied by file refund application," said Chief Justice M. Akil Mochtar. With this provision, the petition of Sarimuda-Nelly cannot be processed for examination in the trial of the Constitutional Court. 

In a letter of application and cancellation to the Court, Candidate Sarimuda-Nelly questioned the violations committed by the Election Commission of Palembang in seven polling stations (TPS). The candidate said they should get the most votes and come out as a winner in the General Election of Palembang 2013. 

As information, the Court had previously ruled in Case No. 42/PHPU.D-XI/2013 filed by Candidate Romi Herton-Harno Joyo on Monday, May 20, 2013 ago. The Court stated in its decision that Romi-Harno as Applicant, leading 23 votes from Candidate Sarimuda-Nelly as a Related Party. In other words, the Court has canceled the victory of Candidate Sarimuda-Nelly established by the Commission of Palembang. (Dodi / mh)
