Bondowoso Election Commission Thought of Petitioner Have No Legal Standing

Dispute of election result of Bondowoso Regency held back at Constitutional Court (MK) on Friday (31/5). Cases registered with Number 55/PHPU.D-XI/2013 filed by Candidate Regent and Vice Regent Bondowoso A Haris Son Haji and Harimas.

 

In its reply, the Commission represented by Robikin Emhas denied all the arguments expressed by the applicant in the previous trial. Respondent’s Exception explained that the applicant has no legal standing, although it was proposed by a combined 13 political parties, but the five political parties problematic. Then, Robikin described three parties, namely the United Nations, the Patriot Party and the Republican Party, revoked its support to the applicant before the application to the Commission regency. "Respondent has verified to the political party official in question was justified and that they have shifted support to the Related Parties," he explained.

 

Additionally, Robikin revealed until the last day of the registration period bearers coalition of political parties cannot meet the number of valid votes of at least 15%. Respondent rejected the Applicant registration would be candidates promoted by the coalition of political parties and return the nomination to the relevant files. Related to this, the Petitioner filed a lawsuit to the Administrative Court Surabaya. "In the end on 4 April 2013, the case decided by verdict `lawsuit rejected the plaintiffs` wholly`," he said.

Meanwhile, the Related Parties of candidate Mustawiyanto-Abdul Manan represented by Syamsul Huda also denied Petitioner. According to Syamsul, parties (subjectum litis) as a condition are not fulfilled in the case of the applicant and one side in objectum litis, Petitioner has no legal status. "In the application is linked to Vote Results Summary regency in 2013. Therefore, it is not directly related to the results of the election," he explained.

 

 

In a previous hearing, the Petitioner through his legal counsel Martin Hamonangan, pointed out that in principle it filed three applications to the Court`s principal. First, the process of registration as a candidate that results in violations of constitutional rights. Applicant`s view, the Respondent has violated the principle of independent, neutral, and independent. Second, Martin said, related to the lawsuit at the Administrative Court of Surabaya. In this case, it objected to the Respondent`s actions continue to implement the Election stages when there is no legally binding decision of the Administrative Court Surabaya. While in principal the third petition, Petitioner questions the bearer party support for Candidate Mustawiyanto-Abdul Manan (Muna). According to Martin, Ulema National Awakening Party (PKNU) has attracted support through a letter dated May 1, 2013 that was sent to the Respondent.
