Three Petitions of Candidate Regents Tanah Laut Rejected

The Constitutional Court (MK) rejected three cases of Tanah Laut election result dispute for entirely regency, on Thursday (30/5). Couples are Atmari-Muhammad Nur (No 1), Abdul Wahid-Norhakim (No 2), and Amperansyah-Ariansyah (No 3). Court ruling stating the principal conclusions third petition was not legally proven.

 

"Verdict: Passing, stated. In the Exception, reject the Respondent`s exception and exception Related Parties. In basic case rejected the petition in its entirety," said Chief Justice M. Akil Mochtar read verdict for No. 50/PHPU.D-XI/2013 filed by Atmari-Muhammad Nur.

 

Against the arguments put forward by Atmari-Muhammad Nur, the Court in a legal opinion stating the arguments, evidence, and witnesses the couple regarding possible violations of administrative and criminal allegations are just a sporadic offense alone. After passing through all the evidence, the Court saw no applicant can demonstrate that the violation has been structured, systematic, and massive and affect the ranking of votes each candidate, so it should be declared legal ground. Nonetheless, the Court recommends that the offenses occurred as alleged can be processed in accordance with applicable law.

 

It is also stated to request Abdul Wahid-Norhakim. Court notice No.51/PHPU.D-XI/2013 Petitioner is not proven by convincing evidence that the offense occurred in a structured, systematic and massive that significantly affect vote totals applicant to exceed the Related Parties of the vote. Therefore, according to the Court, Abdul Wahid-Norhakim argument is no legal grounds.

 

As for the pair of cases filed by Amperansyah-Ariansyah, the Court considers that although the violations alleged and Tanah Laut Regency Related Parties (Bambang Alamsyah-Sukamta) is not proved able to significantly influence the votes of the candidates, but it was likely any offenses such as money politics, voter intimidation, and the non-neutrality of government officials and organizers for the election remain to be resolved either criminal or administrative authority, in accordance with the type of violations by the competent institution.

 

 

With this decision, Bambang Alamsyah-Sukamta since the beginning of the vote ahead of the General Election confirmed as winner of Tanah Laut regency. (Yusti Nurul Agustin / mh)
