The Constitutional Court (MK) to grant withdrawal judicial review Act No. 17/2012 on Cooperatives - Case No. 47/PUU-XI/2013. Thus the provisions of the Constitutional Court judges said on Tuesday (28/5) afternoon at the Plenary Room.
"Petition regarding the petition for judicial review of Article 1, paragraph (1) and subsection (18), Article 50 paragraph (2) letter a and e, Article 55 paragraph (1), Article 115, and the explanation of Law No. 17 of 2012 on Cooperatives pulled back," said Chief Justice of the Plenary M. Akil Mochtar, who was accompanied by other constitutional judges.
As known, the applicant is Pancur Kasih Society, Cooperative Credit Union Sumber Kasih, Canaga Antutn Credit Cooperative and Credit Cooperative Gemalag Kemisiq, which is based on a letter authorizing Sulistiono, SH et al.
To the petition, the Constitutional Court has issued Decree No. 287/TAP.MK/2013 on Defining Panel to examine the petition No. 47/PUU-XI/2013, dated 22 April 2013.
In addition to the Constitutional Court issued Decree No. 351/TAP.MK/2013 Chairman of the Panel on Audit Preliminary Case Number 47/PUU-XI/2013, dated 22 April 2013.
That the Registrar of the Constitutional Court on May 21, 2013, at 16:05 pm, and May 22, 2013, at 12:08 AM has received a letter from the applicant, dated May 21, 2013 which principally apply for withdrawal of case Number 47/PUU-XI/2013.
The request for such withdrawal, the Plenary Consultative Meeting on Thursday, May 23, 2013, has set a recall petition application No. 47/PUU-XI/2013 legal ground.
Furthermore, pursuant to Article 35 paragraph (1) and paragraph (2) of Act 8 of 2011 concerning Amendment to Act 24 of 2003 on the Constitutional Court, "The applicant may withdraw an application prior to or during the examination of the Constitutional Court made" and "The withdrawal referred to in paragraph (1) resulted in the petition cannot be filed again."
