The Constitutional Court (MK) decided seven petitioners in dispute of election result of Sinjai Regency, Thursday (16/5) with a ruling that there are no principal petitioners granted. In the ruling that was read out by Chief Justice of the Constitutional Court Akil Mochtar declared rejected two cases, four cases cannot be accepted, and the case was granted to be withdrawn.
Two cases were rejected its intended lawsuit filed by Candidate Number 5 Andi Seto Gadhista Asapa-Mochtar Mappatoba and cases filed by Mukhlis Isma-Musa Rasyid as Candidate Number Three. The second case was rejected because the arguments of the applicant are not proven and no legal grounds.
Meanwhile, the fourth petition would be candidates namely Andi Muhammad Irwan Patawari-Andi M Takdir Hasyim, Muchlis Panaungi-Zulfikar, Anis Asra-Yahya, and Amsul Sultan A Mappasara-Idham Khalid cannot be accepted by the Court. The court judging the case is the fourth applicant has no legal standing and wrong in application object.
Lastly, the Court granted the petition recall by Candidate Number 6, Lukman H Arsal and Jamaladin. Court in its writ explaining it did not hold since the beginning of the trial, the couple nor the attorney ever appeared in court. The new couple then sends a written request to the Registrar of the Court that the revocation was received on May 7, 2013.
Previously, Candidate Number 5, Andi Seto Gadhista Asapa-Mochtar Mappatoba and Mukhlis Isma- Musa Rasyid objected Sinjai Commission measures that passed Candidate No. 2, Mahyanto Massarappi-Latif Massalinri which should deem unqualified. In addition, two candidates rejected by the Court that his case also disputed ballots translucent not authorized by Sinjai Commission. The findings of translucent ballot piercing is accused by both because Sinjai Commission less to socialize.
Petition of Andi Muhammad Irwan Patawari and Andi M Takdir Hashim linked to cross support of Hanura, the Court stated in its legal considerations that occur because of the inconsistency of support made by Hanura.
Court also emphasized that the Court did not find any set of facts and convincing evidence that the Commission Sinjai had obstructed Candidate eligibility or otherwise, pass the Candidate Will that do not meet the requirements to participate in the General Election with a bias or motive to win or defeat particular would be candidates.
