The Constitutional Court (MK) held a second hearing in judicial review of Act 8 of 1981 on Criminal Procedure Code and Act 48/2009 on the Second Amendment of Act No. 14 of 1985 filed by I Made Sudana. In this session Petitioner deliver improvements in the petition.
I Made Sudana using video conferencing facilities from Udayana University Bali has improved his petition convey the advice of the judge. Sudana clarifies the reason for his application accompanied by additional arguments.
"If we look at the level of the Supreme Court decision in the judicial review of the decision after the first mention of the indictment described the prosecutor, also said the contents of the district court decision, the high court’s decision, and the Supreme Court’s decision in the appeal. This decision meant that publishing consider in making its decision. But the Supreme Court’s decision in the review of the level of these things just does not consider the content of the decision considered alone. Well, because that is the situation we are strongly feeling of Party flaws in judgment made by the Supreme Court in the reconsideration level," explained Sudana back revealing argument petition.
Responding to petition improvement, the Constitutional Court justice Harjono said that the Court would be just say that if there is demand beyond the authority of the Court, it will be decided whether or not the authority of the Constitutional Court. "But things are within the jurisdiction, will also be examined. Therefore, in my opinion, just waiting for the next Mr. processes subsequent to the examination at the Plenary Session," said Harjono.
Meanwhile, Chairman of the Panel, Maria Farida Indrati said it will submit the case to the Justice Meeting and ask Sudana wait for the continuation of this case. Maria also endorsed five exhibits submitted by Sudana.
"I endorse that evidence. So you just wait how the continuation of this case. Dad will be notified later after we submit the case to the Consultative Meeting. So you wait. If you would ask experts, you can also do it from Bali. Because there is also a criminal law expert, you can ask there. But if not, it is okay.
