Chief Justice of the Constitutional Court of the Republic of Indonesia (MKRI) M. Akil Mochtar received Georg Witschel arrival, Ambassador of the Federal Republic of Germany to the Republic of Indonesia, Monday (29/4) afternoon at the Constitutional Court (MK). During the meeting various issues surrounding the constitution to be interesting talk.

"In Indonesia, only Indonesian citizens were able to review the law to the Constitution. Germany is EU member, if for example there are European citizens who object to state regulation in Germany, he could be reviewed in the German Constitutional Court," said Akil Mochtar, who was accompanied by the Secretary General Janedjri M. Gaffar.

Georg Witschel justifies Akil Mochtar statement on the matter. He argued, because the constitutional test is not only true for German nationals, but the question must be living in Germany.

"Once again, that is the problem in the context of the European Union, a lot of cases against the Lisbon Treaty. Now more highlights problems of the euro," said Georg.

Other things, Georg answer questions the role the European Central Bank or the European Parliament should issue a legal product or not. Products legally binding German citizen, in this context is the German Constitutional Court, not to test the law issued by the German government.

"German Constitutional Court should not interfere in the context of the laws issued by the agency, because they are not the German Constitution. Thus, the Court issued a decision that should only be applicable if the law in Germany, with which the EU competence violates German law beyond the limits of competence," explained Georg.

Akil said that not long ago the people doing the testing related to the ASEAN Charter Law or free trade in South Asia. According to the Petitioner test the law, it is detrimental to the people of Indonesia, especially for small businesses when it is implemented.

"It was very exciting to see the future. Increasingly closer economic integration, the greater the problems that can arise from person to person," said Georg.

Furthermore Georg said, if there is justice in Indonesia concluded that the laws that should be applied to the problem deemed incompatible with the constitution.

"I saw that this court will submit this issue to you as Chief Justice," said Georg to Akil.

"In such a context, the ongoing trial should be dismissed and awaiting a decision from the Court," said Georg.

Specifically Georg also appreciates the performance of the Court who has thought hard juridical and constitutional. According to Georg, thanks to the hard work, the Court very respected people. "The Constitutional Court of the Republic of Indonesia has respect in the eyes of its people, is a respected institution in Indonesia. Due to his professional, neutral and not take sides anywhere, and it’s been ten years standing, respected are the consequences," said Georg.

Georg hoping his side can continue to cooperate with the Court. "I hope that the existing cooperation can be improved further for the future," he said. Meanwhile Akil said German Ambassador to be a good move to strengthen ties between the two countries.
