Chief Justice of the Constitutional Court (MK) M. Akil Mochtar to speak at a one-day seminar on Constitutional Rights of Women and the Reality of Legal Pluralism in Indonesia organized by the Legal Aid Association of Indonesian Women for Justice (LBH), Monday (29/4). Akil in front of the audience said it welcomed the event as this seminar to review issues relating to the constitutional rights of women and children.
Akil said in his speech, the seminar reviews intersect directly with the function of the Court as the guardian of the constitution and protection of the constitutional rights of citizens. 1945, continued Akil, very clearly gave recognition and guarantee of constitutional rights of citizens, including women and children. Therefore, Akil confirmed efforts to realize the rights of women and children into the realm of practice must have the support of all parties.
Associated with other central theme of the seminar is the formation of a family court or family court in Indonesia, Akil said the idea is interesting and the family court may give new hope to provide better access to women and children in order to get justice.
"At the level of ideas, ideas to make family law more responsive, including the desire to form an integrated family justice system, either through a special court or chamber system, a legal political territory thematically very interesting," said Akil in the Hall Ground Floor of Constitutional Court Building.
The presence of an integrated family court by Akil is one of the solutions to address and resolve issues duality and dichotomy of law, in addition to the need for the need for comprehensive change or reform family law. Family law reform was also considered important by Akil to do because it gives the law and the practice of family law is still putting women in a subordinate position and discriminated against.
Related to the function and role of the Constitutional Court, Akil said if the family law reform really wants to do then it should not be just limited to the state policy, but also on legal institutions and social. Although the constitution prohibits the Court engage in the process of designing or establish legal norms, but the Constitutional Court is ready to provide support. "The Court is ready to provide support to any initiative-oriented fulfilled and protection of constitutional rights of citizens, for the enforcement of the constitution, and for the victory of law with justice," said Akil.
For that, Akil, the Court can facilitate scientific forums such as seminars held this LBH. "Please discussions like this continued and developed. I believe, in a democratic country and uphold human values such as Indonesia, with all family law enforcement practices that reflect these values as well as in line with the 1945 Constitution can and indeed must be realized," said Akil closing remarks.
