Palopo Election Commission Accepts Nothing of Recommendations from Supervisory Committee

Dispute of Election Result of Palopo City with case number 30/PHPU.D-XI/2013, held back on Wednesday (17/04). Agenda session led by Judge Hamdan Zoelva are listening to the answer of the General Election Commission (KPU) as the Respondent, hearing from couples HM Judas Amir-Akhmad Syarifuddin (JA), as well as checking the testimonies of the witnesses presented by Haidir Basir- Andi Thamrin (HATi), the Petitioner in this case.

Couple HATI accuses second round implementation of Palopo Election are colored structured, systematic and massive (TSM) violations. Mapinawang, as the attorney of Palopo Commission states, the petition filed by the candidate number 5 Haidir Basir-Andi Thamrin, it questioned more violations committed by JA couples, either money or political involvement of Civil Servants (PNS). 

Mapinawang further reveals that most Commission’s officers accused by Couple HATI, they still participate in the second round of implementation of Palopo Election which was delayed, due to the implementation of the first round of the disputed General Election to the Court, and was decided on February 21 2013. To fill the shortage of officers both at the district, sub-district and polling stations (TPS), it has made recruitment and throughout the second round of the Election organizers have received the appointment of Palopo Election Commission’s Decree.

Infringement Claims

While Yasser Wahab, JA assess attorney petition filed by Couple HATI unclear and vague, according to Yasser, the jurisprudence has provided a structured definition of violations, systematic and massive or TSM. In the context of the TSM violations, according to JA is not possible in such violations, because Judas Amir is not Palopo government officials, but members of the Regional Representatives Council of Luwu Regency, while Akhmad Syarifuddin is a teacher, so they do not have anything to do with the municipal government of Palopo.

Yasser further argues couple HATI cannot demonstrate a causal link between the violations that occurred with the voting results of each candidate, as evidenced from several villages who argued the practice of money politics by the JA, as it HEART successful applicant with the most votes. According to Yasser, HEART couples who have done the offense of intimidation of civil servants and the practice of money politics, evident from the reports to the Supervisory Committee, which secretary of Jaya village named Makmur, intimidate civil servants to choose HATI.
