The Constitutional Court (MK) held a trial on dispute of election result of Regional Head and Deputy Head of Deiyai District - Case No.97/PHPU.DX/2012 - on Thursday (7/3) afternoon. The agenda was a briefing session of Deiyai election commission members and representatives of the Governor of Papua. Present at the hearing, including the Principal Petitioner, Natalis Edowai accompanied by legal counsel Mulyadi M. Pilian, et al.
Starting the session, John Mote as KPU members of Deiyai revealed, on February 7, 2013, the secretary and treasurer of the District Election of Deiyai has applied for funding to the Regional Government of Rp3 billion. Then on February 15, 2013, the leadership of the local parliament has signed a consent principle of funds fulfillment of Deiyai repeat voting (PSU). "The next day, Deiyai Election Commission coordinated with Papua through Region V Coordinator Papua in Jayapura on delay implementation of this PSU," said Mote told the panel of judges, led by M. Akil Mochtar.
Mote continued, on February 19, 2013, the Commission has implemented Deiyai District plenary meeting, which was attended by the chairman, three members, and the secretary of the Deiyai Election Commission to discuss and report on the implementation of the PSU for 60 days to the Constitutional Court in Jakarta. "On the same date, the Commission was also invited by the Deiyai District Regent to ask PSU readiness and implementation process, as well as to implement the same perception that PSU is pending," said Mote.
Mote also clarified that there are two letters that go to the Constitutional Court. "We feel that the two letters to the Court’s entry occurred not because of a particular interest or motivation. Just because one thing, Deiyai election commission members unaware of a letter on behalf of Deiyai District Election Commission No. 9/KPU," said Mote.
Meanwhile, Rosina Upessy Papua as the governor representative explained the implementation of the PSU in the District Election related Deiyai Regent and Vice Regent, which has yet to materialize. "We want to explain the appropriate conditions. That the General Election on any local, provincial or district / city are the responsibility of local government and the Election Commission is an independent executor or organizers," said Rosina.
It says Rosina again, the actual funding related to budget with each expense and imposition was supposed to allocate funds for it to be for 2 turns Election. "And for that, the Government of Papua Province kept looking at implementation of the PSU remains a task even the responsibility of district governments, in this case the Deiyai regent officials as that will facilitate and the Commission as the sole organizer of the election," said Rosina.
