Court Rejected Dispute of Election Result of South Aceh District

Petition on dispute of election result of South Aceh district head was rejected by the Constitutional Court. Petition filed by the two candidates, No. 5 M. Natsir and Zulkifli and Candidate No. 2 M. Ridwan Saleh and A. Rahman was read by the Constitutional Court Plenum of the Constitutional Court chaired by Mohammed Alim, Wednesday (6/3) afternoon.

"The argument of the Petitioners petition unproven and unwarranted under the law," said Alim Decision No. conclusion when reading. 11/PHPU.D-XI/2013.

Harjono stated, the applicant cannot prove either the Independent Election Commission District. South Aceh (Respondent) and Elected Candidate T Sama Indra and Kamarsyah (Related Parties) have done violations structured, systematic and massive which can significantly affect the ranking of the vote each candidate. "Therefore, all the arguments of the Petitioners unproven and unwarranted under the law," he said.

Previously, the applicant revealed various violations by the Respondent or Related Parties. Among Petitioners argue about Candidate No. 6 Wahyu M Wali Putra and Irwan who do not meet the requirements of the combined support of political parties, but was passed by the Respondent, the bubbling sound, underage voters, as well as differences in the number of voters between polling stations.

Have No Legal Standing

Against the petition filed by the Candidate Zulkarnain and Irwan Yuni, the Court declared unacceptable. In Decision No. 12/PHPU.D-XI/2013 Court reveals that the applicant has no legal standing to file the petition.

"According to the Court the Respondent’s exceptions and exceptions Related Parties concerning Petitioner has no legal status (legal standing) proven and reasonable laws, therefore other exceptions, as well as filing deadline and the principal issue was not considered," said Ahmad Fadlil Sumadi.
