Law Must be the Commander

Singapore (ANTARA News) – Chief Justice of the Constitutional Court (MK) Mahfud MD said to fix and resolve the problems that occurred in Indonesia today, the key to making the law as commander. 

"The problem of social, economic, political, social and cultural rights can be resolved if the law will be enforced indiscriminately. Laws as the Commander," said Chief Justice of the Constitutional Court Mahfud MD when giving a public lecture entitled "Indonesia` s Second Wave of Reform" at the S Rajaratnam School of International Studies (RSIS) Singapore on Wednesday. 

According to Mahfud, becoming law as the commander is an obligation to do that Indonesia now. 

Mahfud explained further in the various sectors of the damage has occurred. In the political arena, he added, the power relations marred by nepotism and transactional politics. 

In the government sector, many officials indicated even some have proven to behave corruptly. 

The law enforcement sector is not optimal. The law strongly suspected to be blunt because it is controlled by mafia law. 

"But democracy without law will lead to chaos and undermine democracy itself, because what happens is undermining democracy by democratic means. Then I often shout that democracy must be built in line with the development of the law," said Mahfud 

Mahfud explained further after the reform, democracy has manifested to all sectors. But it turns out democracy still leaves many questions. 

"Freedom of politics and got a warranty but not matched by the quality of civil liberties that democratic Indonesia is excessive," said Mahfud 

Mahfud judge’s happening now is actually at the level of implementation of the uncertainty is because democracy is the wrong direction. The development of democracy in the wrong direction, he added, the appearance of political leadership and governance and transactional politics is characterized by mutual hostages. 

According to Mahfud, democracy is built change into an oligarchy, so the decision was taken by the political elite oligarchy mutually. 

"The law does not wake up because of democracy. Democracy turned oligarchy," said Mahfud. 

While there are still shortcomings, Mahfud acknowledges the significant progress. Among other things: first, with the amended Constitution 45 have balanced power structure. Formerly the power was highly centralized in the hands of the president. 

"At this time, power is no longer concentrated in the hands of the president, but rather spread out to several state agencies are balanced so that the structural relationships awakened by ‘checks and balances’ and there is no dominance of one state agency," said Mahfud.

Another success Mahfud added no human rights violations in Indonesia. 

"Constitutional Court is also a major advance," said Mahfud.
