Dispute of election result of Purwakarta District 2012 was rejected by the Constitutional Court. Decisions Number 3/PHPU.D/XI/2013 was read on Tuesday (29/1) at the Plenary Court. In essence, the Court concluded, Petitioner’s arguments are not proven according to law. "Rejecting the petition for all," said Chief Justice Mohammad Mahfud MD as Chairman of the Plenary Session.
"With regard to Petitioner regarding witnesses in TPS that uses attributes Related Parties, the Court considered, the Election violations argued by the Applicant was sporadic," said M. Alim. "Therefore, according to the Court, the argument was not unreasonable under the law,"
Later, the Court also said there was not enough evidence to convince the Election violations that are structured, systematic and massive that can change the ranking of the vote each candidate. "Given the difference in sound between Related Parties Applicant number of 190,643 votes, so it should be declared legal unwarranted," he added.
Moreover, the argument related to the use of the applicant’s local budget funds, the Court is Petitioner does not demonstrate the influence and significance of the vote each candidate, so that the law should be declared unfounded.
"If there is a crime that occurs, it can be processed according to the law," said Alim. Based on these considerations, the Court, Petitioner’s arguments are not proven according to law.
Previously, the Petitioner argues that the violations occurred structured, systematic, and massive. It was occurred fraud, intimidation, and money politics by the Related Party and the state apparatus / PNS. In addition, Petitioners argue the violation was committed by the Respondent, the Related Party and state officials / civil servants on Election Day at the polling stations and the use of local budget Year 2010, Year 2011, and in 2012 was illegal under the Related Party.
As the Respondent in case No.3/PHPU.D-XI/2012 of Election Commission of Purwakarta District, the Related Parties is Candidate Number 2 Dedi Mulyadi and Dadan Koswara, while the applicant is Candidate Number 1 Dudung B. Supardi and Yogie Mochamad. (Utami Argawati / mh)
