Dispute of election result of Sampang Regency filed by Candidate Number 6, Herman Subaidi and Dja\'far Shodiq, was rejected by the Constitutional Court. It is as contained in Decision No. 102/PHPU.DX/2012 read out on Tuesday (15/1) afternoon, at the Plenary Room, headed by Deputy Chief Justice of the Constitutional Court Achmad Sodiki.

 

"Declare to wholly reject the petition," said Achmad Sodiki.

 

Court\'s view, the Petitioners\' argument is not supported by convincing evidence that the offense occurred in a structured, systematic and massive significantly affect the vote applicant to exceed the number of votes the Related Parties. "Therefore, according to the Court, the Petitioners\' argument is unproven and unwarranted under the law," said Constitutional Judge M. Akil Mochtar.

 

As for the practice of money politics by the Related Parties, the Elected Candidate A. Fannan Hasib and Fadhillah Budiono, the Court was revealed in the trial even though Petitioner did not postulate it. However, the Court found, this does not prove to affect the number of votes between the Petitioner and the Related Parties.

 

The District Election Commission of Sampang (Respondent) who has made the opening of the ballot box as questioned by the Petitioner, the Court can still be justified. The action is in the context of evidence in Court.

 

Furthermore, according to the facts trial, the opening of the ballot box was attended also by the District Election Supervisory Committee. Lacquer and police officials as well as to invite Success Team each candidate. "According to the Court, there is no indication the Respondent intends to change the voting results in Forms C and D form, thus changing the composition of the vote has been set. Therefore, the Court a quo Petitioners\' argument is groundless according to law," said Akil.

 

Previously, Petitioners argued several violations and fraud during Sampang Election 2012. Among them is the closure of polling stations before the specified time, a number of 2727 voters petition is granted Form C6 and voter cards so cannot give right to vote, the voting ballots is done outside the polling booth and performed more than once in some polling stations, and the promise of the return of land to the public.
