The Constitutional Court granted the withdrawal of the Case Number 106/PUU-X/2012 filed by some political parties. Assessment recall was read by Chief Justice of the Constitutional Court, Moh. Mahfud MD. He was along with eight other constitutional judges, Thursday (3/1) at the Plenary Court.
"To grant the application for withdrawal of the petition of the applicant," said Mahfud. "Ordered to the Registrar of the Constitutional Court to issue a Deed of Cancellation Registration Application for the Case Number 106/PUU-4X/2012 and restore files a quo to the petitioners."
Decree issued by the Court on the recall petition filed by the Petitioner by letter dated 19 November 2012. The applicant in this case consists of the Crescent Star Party (PBB), Democratic Renewal Party (PDP), the Prosperous Peace Party (PDS), Justice and Unity Party of Indonesia (PKPI), Ulema National Awakening Party (PKNU), National Party Populist Fortress (PNBK) Indonesia and the Labor Party.
Earlier, the petitioners test of Article 15, Article 16 paragraph (1), Article 16 paragraph (2), Article 16 paragraph (3), Article 17 paragraph (1), Article 17 paragraph (2), Article 17 paragraph (3), Article 17 paragraph (4), and Article 17 paragraph (5) of Law No. 8 of 2012 on the General Election of Members of the House of Representatives, Regional Representatives Council and the Regional Representative Council against the Constitution of the Republic of Indonesia Year 1945. The consequence of this recall, the applicant can not apply the same to the Court. (Dodi / mh)
