In principal the petition, the Petitioner was violated by the operation of Section 12C of Act No. 21 Year 2001 on Special Autonomy for Papua. Article 12c states "That can be elected as Governor and Deputy Governor is a citizen of the Republic of Indonesia to the following conditions: (c) at least degree educated or equivalent". The applicant is a graduate of Upper Secondary School (SLTA) is concerned with the provisions of Section 12C of Law No. 21 Year 2001 on Special Autonomy for Papua. Minimum educational requirement as low "degree or equivalent" in section 12C of Act No. 21 of 2001 on Special Autonomy is the Petitioner is very unfair and violates the constitutional rights of the Petitioner, the terms’ education as low "degree or equivalent" in section 12C in Act no. 21, 2001 is not part of the specificity of the Papua Special Autonomy so there is no legal basis for a sustained and highly discriminatory. "As has been confirmed also by the Constitutional Court in its decision No.. 81/PUU-VIII/2010 dated March 2, 2011 and decision No. 3/SKLN-X/2012 dated 19 September 2012, Papua specificity with respect to the election of Governor and Deputy Governor, is related to the authenticity of the Papuan people as a candidate for governor and vice governor," said the applicant’s attorney, Habel Rumbiak.
