Commission III Consultation Meeting with Chief Justice of the Constitutional Court

Chief Justice of the Constitutional Court (MK) Moh. Mahfud MD, accompanied by the Secretary General of the Constitutional Court Janedjri M. Gaffar invited in Consultation Meeting of Commission III of the House of Representatives (DPR), on Tuesday (4/12), in the Commission Meeting Room III, Jakarta. The event was chaired Deputy Priyo Budi Santoso, accompanied by Deputy Commission III Tjatur Sapto Edy.

Consultation meeting discussed among others the term constitution that some judges will end, including Mahfud tenure. In addition, the event will also discuss about the laws governing the Constitutional Court, as well as the achievements and measure the success rate of implementation of tasks and authority possessed by the Constitutional Court.

In early speech, Mahfud straighten disinformation related to the question of stepping down as chairman of the Constitutional Court judge constitution. He said, he never sent a letter of resignation related to the Parliament as a constitutional judge. He was only carrying out orders the law that the judge ended his constitutional duty to report 6 (six) months to agency selection.

"Exactly, Chairman MK tells Parliament, the President, the Supreme Court judge who ended his term of at least 6 (six) months before his term was over," he explained. "So, did not resign, does the law requires me to report to the agency that chose me," added Mahfud.

With regard to the surrounding Act (Act) Court, Mahfud said, all issues related to the Act to be repaired or made new fully submitted to Parliament. Because, said Mahfud, a time by the Act has the potential to be tested against the 1945 Constitution Act. "Every law has the potential to one day be sued by the people (to MK)," he explained.

In addition, Mahfud also describes the size or performance tasks and authority of the Court has been performed according to the meeting agenda. According to him, the size or the achievements that have been made by the Court may be qualitative or quantitative. If it is qualitative opinion of the judges come from the constitution itself, and is qualitative shaped figures, the number of cases that have been handled by the Court.

According to him, the number of cases that go to trial the Court each year has increased significantly. It was thus known, because every semester constitutional judges make a docket entry and decided cases, and the results have increased. "It is certain productivity every year we go up, from produkfitas about the decision, until productivities of cases handled," he said.

In the records of the Constitutional Court Mahfud described in the meeting, in 2012 there were 58 testing cases law that has not been terminated. It thus is a record that has never been experienced by the Constitutional Court. "This year, there are 58 cases of Act that has not been terminated. It (the case of Act) is a record, because usually every year only live about 15 cases, "said Chairman MK’s.

After listening to Mahfud presentation linked to the performance of the Constitutional Court, a member of the House expressed appreciation for the performance of the Court over the years. According to him, as well as held a hearing is always on time, the hearing in the Court is quite transparent. "In general, I see that the legal process event in MK I really appreciate and respect," he said.

Not enough of it, other lawmakers also asked the Chairman of the Constitutional Court to give advice on how to judge the qualifications and recruitment of good constitution. According to Mahfud, the House is not in sufficient capacity to test the expertise of Constitutional Court judge candidates.
