Petition on dispute of election result of General Election of Batu City is rejected by the Constitutional Court. According to the Court, the petition filed by three candidates’ mayor and deputy mayor is not proven and unwarranted by law.
"Principal Petitioners petition for partial and not authority for the rest of the Court and has not been proven according to law," said Chief Justice of the Constitutional Court, Moh. Mahfud MD. He read the verdict on Monday (5/11) at the Plenary Court. "Rejecting the petition of the applicant for all."
According to the Court, things associated with diploma / STTB / Letters Substitute diploma and other papers in question by the applicant relating to the status of the Related Party, Elected Candidate Eddy Rumpoko - Punjul Santoso, as participants Batu Election 2012, was not authorized Court. "Thus, the Court does not consider it," said the Court in Decision No. 76/PHPU.D-X/2012.
"Therefore, the petitioners regarding the legal process can continue to the authorities even for cases that deal with the results of the General Election has been done in court," said the Court.
Furthermore, the fact of the administrative court ruling that Surabaya has gained legal force, according to the Court, was also carried out by the Electoral Commission of City of Stone (as the Respondent in this case), and the Court did not find convincing evidence to the contrary. Therefore, it can not influence the process of implementation of the Stone Town Election and the vote of each candidate.
"Considering that the Petitioners argument about the existence of other violations, according to the Court, not substantiated with convincing evidence that another violation occurs in a structured, systematic and massive significantly affect the number of votes the petitioners," wrote the Court in the judgment as thick as 111 page.
