Maria Farida: Constitution of Indonesia Set Human Rights Clearly

Indonesia's constitution states clearly on Human Rights (HAM), which resulted in the obligation to provide any protection for its citizens, including the same between men and women. Therefore, all Indonesian people deserve a decent life, so that the state is obliged to build facilities and infrastructures.

So says Maria Farida Indrati as the Constitutional Court judge before dozens of representatives from 10 Ministries / Agencies of the State in the event of Trainer Training (ToT) on "Efforts to Maintain and Compliance Assurance Constitutional Rights of Citizens" at Acacia Hotel, Jakarta, Thursday (27/9).

"The constitution governing the rights of every citizen, the state must provide (the right to life of all citizens)," said Maria Farida in an event organized by the National Commission for Women (National Commission on Violence against Women) this.

Furthermore, Maria Farida reiterated, human rights contained in the Constitution is no longer a problem. Therefore, the constitution of the Indonesian people not tell the difference between the rights of men and women, but only said that every human being and citizen. "So the development of the constitution much more accepting of those rights (men and women)," he explained.

But, says Professor of Science, University of Indonesia Regulations, Constitution only set the terms of a general nature. As a result, all contained therein will be governed under the rules hereunder, i.e. ranging from legislation to regulation at the level of the bottom.

On the other hand, Maria Farida also said that it really makes the rules similar to the law is not difficult, as long as it does not conflict with the norms prevailing in society. "I say make rules is not difficult, but if we make a rule, are not included in the norms that already exist," he explained.

These norms include religion, morals, and customs. Therefore, Maria Farida continued, when it comes to making rules of the existing problems in the three norms, the creation of legislation will not be easy to do. "So that makes the rules relating to the three norms are not easy," he explained. So in the Marriage Act, he said, saying the marriage valid if conducted according to religion or belief, and was followed by the recording of the book states.

In addition, Maria Farida also explains the basis associated with the formation of the 1945 Constitution. According to him, the establishment of the 1945 Constitution which was conducted in accordance with the basics clears, and not formed by random. "For me, if we make laws or constitution, we should see existing laws, we may see American law, and the Dutch were good. But once we are united in the constitution should be able to flow and be good (for the Indonesian people)," he explained.
