Aiming to study the system of the Constitutional Court of the Republic of Indonesia, Japan Takehiko Otani Justice came to visit MK on Thursday (27/9). Otani visit accompanied by the Chairman of the Court of Appeal Osaka Mitsuyasu Matsukawa was received by Deputy Chief Justice of the Constitutional Court Achmad Sodiki with two other judges, namely Maria Farida Indrati and Anwar Usman.

"Visit Japan's Supreme Court is the first in 30 years. The opportunity given to me to pay a visit to Indonesia is very rare. Japan does not have the Constitutional Court, but the Supreme Court. It was thought necessary to the Court in Japan, but no steps to make it happen. On this occasion, we would like to study the existing system in the Constitutional Court of Indonesia," said Otani open conversation.

In response, Sodiki explain Constitutional Court is the agency carrying out the functions of the judiciary in Indonesia other than the Supreme Court. Constitutional Court, continued Sodiki, also a result of the reform of the 1945 Constitution. "Constitutional Court has the authority to decide reviewing Act against the Constitution, resolve disputes between state institutions, dissolution of political parties, completed the election, an opinion if the president committed a crime. We have completed 1300's case until the year 2012, "he explained.

Otani was amazed by the amount described Sodiki. He also said that meant per year Constitutional Court successfully completing 100 cases. "Constitutional Court was very heavy duty and has worked hard. Are all incoming cases attended by nine Constitutional Court judges?" Otani questioned.

According to Sodiki, the hearing panel, the constitutional judges usually divided into three judges, then after a new panel of nine judges attended the constitution. "The nine judges on the court are divided into three panels, but when its panel, will be brought to the meeting deliberations Judge (RPH), which was attended by all the judges. And every decision involving all the judges, "he said.

Discussions also continue with the discussion on the selection of judges, Sodiki explained, judges proposed by the House, Supreme Court and the President. "In Indonesia, it is formed a selection committee composed of professors to academics. Election was held open. The public was allowed members of criticism. While the House of Representatives of the proposed Judicial Commission and submitted to the House and been to three, "he explained.

Unlike in Japan, Otani explain justices in Japan consist of 15 people. The essential requirements are to be experienced 20 years old and were selected from among judges, lawyers, and academics. "It is the authority of the cabinet. Cabinet itself does not have information about the judge. Usually the Chief Justice proposes justices and cabinet chief justice respecting proposals. This proposal has not been rejected by the cabinet. This gives rise to criticism because there is no transparency, "he said. (Lulu Anjarsari / mh/Yazid.tr)
