The Indonesian people have the full right to make its own constitution, and agreed that the conduct of the state and all citizens required running it.
As stated by Chief Justice of the Constitutional Court, Moh. Mahfud MD as a guest speaker at the event Public Lecture on the theme "Further Amendment Act of 1945" in the framework of the 60th Anniversary of the University of North Sumatra, in the Great Hall Moot Court Building University of North Sumatra, on Saturday (01/09).
Today, there are many parties who questioned the 1945 amendments, both in terms of systematic, content validity of the procedure, and the material in it. In addition, the amended constitution is said to be an elite product that contains a lot of things are not right and there are many irregularities. Therefore, the 1945 amendments still need to be corrected in total through further amendments. On this basis according to Mahfud, needed clarification on some crucial issues related to the 1945 amendments.
In terms of the content of the constitution, Mahfud said that Indonesia had a right to make its own constitution theory. "The law applicable state structure in a country is anything written by the people of the country itself in the constitution," said Mahfud. Regardless of good or bad, the contents of the Constitution are the result of an agreement (resultant) that must be executed. "Every country has a constitution in accordance with the country's own domestic needs. That's why, no one really relevant to say of a law," said Mahfud.
At the end of the delivery Mahfud said, will not need to further amend prohibited, but must be accommodated with other opinion then channeled through the constitutional process in order to birth the Constitution that reflects the will of the people. "Most importantly, if the amendment should be continued in the context of improving and refining existing ones, not in order to narrow the accommodation of the interests previously not or fail to fit," he said.
