Election Result of Tolikara District to be sued

Candidate number two of Tolikara District Election John Tabo-Hedi Suyanto sued the Election results to the Constitutional Court with the hearing held on Monday (7/5), at the Plenary Court Room. The first hearing cases registered with the Court Registrar No. 34/PHPU.DX/2012 chaired by Deputy Chief Justice of the Constitutional Court Achmad Sodiki.

In the main petition, the Petitioner was represented by legal counsel, Arie Pujiyanto, et al, disclose it objected to the recapitulation result issued by KPU Tolikara as Respondent. Arie explains interim successor should the Commission do not re-verified candidates who passed the number 1 candidate, Amos Djikwa Wanimbo Usman (Related Parties). KPU chairman Tolikara as interim replacement, the Hoseam Kenongga, known to be a cousin of Usman Wanimbo.

"It has nothing to do with the escape of blood relationship partner, Amos Djikwa Wanimbo Usman. However, with the seat Hoseam Kenongga as interim replacement for the Commission passed a brother Usman Wanimbo, but based on the results of verification of the previous Commission, Usman Wanimbo-mate Amos Djikwa only supported as much as 6.61% of the votes of political parties. The results of this verification were issued on August 12, 2011. Based on the verification, the applicant is supported by 21 seats in parliament or 73% of the vote. Meanwhile, other candidates would, Panus Timotus Kagoya and supported by 17.9%. Whereas the Commission only authorizes the District Election Commission Tolikara as interim replacement for the continuing phases of the election before the Commission determined, but in fact the Commission interim substitutes instead re-verify and make as if Wanimbo Usman escaped into a pair of candidates, "he explained before the Constitutional Assembly.

In addition, Petitioner also argued that when it turns out Usman Wanimbo replace the vice-regent beyond repair the file, when the registration and verification. When the registration of, Usman took Benny Kogoya as vice regent, but when the verification of, Usman actually took Amos Djikwa. "It has requested clarification from Regency Tolikara by local election supervisory committee of Tolikara District. But until the election, there is no clarification or submission of the nomination file Usman Wanimbo-Amos Tolikara Djikwa of Regency, "he explained.

The unclear replacement of PPD and PPS by the Respondent and the voting in 23 districts is another reason for the Petitioner filed a petition. PPD and PPS revocation of members in each district, according to Arie, the Provincial Election Commission has given instructions to the Respondent, but ignored by the Respondent."The worse, the Respondent did not issue a decree to this day PPD replacement," he said.

In this preliminary hearing, the judges of the Constitutional give advice on the petition to be used as a repair. On the issue of determination of a candidate by a majority vote, the applicant must prove. Then the calculation is not correct in seven districts, the applicant shall submit written evidence of the calculation. "The applicant must prove. Respondent must maintain. Petition has been good. If you need a witness, it should bring witnesses. If you need a document to be prepared," advises Constitutional Justice Harjono.
