The Constitutional Court (MK) ordered the Election Commission to implement the Buton Regency Constitutional Court Decision No. 91-92/PHPU.D-IX/2011, dated 21 September 2011, no later than 60 days. Decree No. 91-92/PHPU.D-IX/2011 thus read by Constitutional Justice M. Akil Mochtar, accompanied by seven other constitutional judges on Thursday (22/3), at the Plenary Court Room. Petition is filed by Candidate pair of Regent and Vice Regent of Buton La Uku - Dani and Samsu Umar Abdul Samiun - LA Bakry.
"Telling the Buton Regency Election Commission to implement the Constitutional Court Decision No. 91-92/PHPU.D-IX/2011, dated 21 September 2011, no later than 60 days after the decree was pronounced, and report the results to the Constitutional Court. Ordered the Election Commission, Board of Trustees Election, Election Commission of Southeast Sulawesi Province, the General Elections Supervisory Committee Buton Regency, and the Ministry of Interior (in accordance with its authority in conducting the general supervision of the Regional Administration) to oversee the process of implementation of the ruling of the Court Number 91-92/PHPU.D-IX/2011 constitution, dated 21 September 2011 and this resolution and to report on the implementation and the findings submitted to the Constitutional Court, no later than seven days after the completion deadline as set forth in this ordinance commanding unity, "Akil said.
Akil explained there is a set of facts and evidence at trial revealed the existence of actions that directly or indirectly from Buton regency administration officials to hamper the conduct of the Constitutional Court Decision No. 91-92/PHPU.D-IX/2011, dated 21 September 2011 . This is done by not feeding it or not dilutes the voting re-implementation of the budget Buton District Election Year 2011, as commanding the Constitutional Court and Election Commission intervened in the performance of Buton Regency. "It has been available for the implementation of the budget re-votes in accordance with the verdict of the Constitutional Court Decision No. 91-92 / PHPU.D-IX/2011, September 21, 2011. Therefore, the Court is no reason for Buton District Election Commission not to implement the ruling of a quo, "he explained.
Furthermore, Akil describes the verification of the candidate’s individual elements that have been implemented by the Buton Regency whose results have not been set by the Buton Regency. According to the Court, continued Akil, for the efficiency of the implementation of the verdict, Buton Regency continued implementation of the verification was done by making an assessment and verification results establish individual candidates are eligible, as well as administrative and verify factual verification of the candidate re- proposed by political parties. To avoid differences of opinion concerning the implementation of the Constitutional Court's decision giving rise to legal uncertainty, the Court should give a time limit for implementation of the orders worth the provisions of the Constitutional Court a quo. "The implementation of the decision shall in addition be supervised by the Electoral Commission, Board of Trustees Election, Election Commission of Southeast Sulawesi province, and the Election Supervisory Committee of Buton Regency, it also should be monitored also by the Ministry of the Interior as a public watchdog of government in the area so that all devices rules that allow for the provision of the budget to be correctly and the maximum and not inhibited in its use for the implementation of the Constitutional Court decision, "he said.
