Suyanto read that RSBI and SBI do not like the applicant alleged that states are both contrary to the spirit of the nation. Indeed, continued Suyanto, in order to intellectualize life of the nation, the government shall establish and conduct a national education system that serves to develop skills and form the character and civilization of the nation’s dignity.
Furthermore, Suyanto explained that the development of science and technology is developing rapidly at this time led to new demands in all aspects of life, including education Indonesia’s competitiveness in the global scale. RSBI which is currently under development it comes to producing graduates that exceed national standards that have comparatively high competitiveness, including the ability to communicate in a foreign language. "Therefore, in our opinion, RSBI or SBI is not contrary to the spirit of the nation," said Suyanto.
In charge with Petitioner accusation that SBI and RSBI lead to discrimination in education, it was also rebuffed by the government, represented by Suyanto. The Government party argued that based on the psychology of learners can be divided into ability groups are less capable learners, capable of being, and highly capable.
"Students in the educational unit RSBI and SBI was among the students who have a high potential intelligence or talent. The treatment is not discrimination, because according to the decision of the Constitutional Court stated that No.27/PUU-V/2007 just treat it differently to different things that did not discriminate, "said Suyanto.
Bombarded with questions
This time the hearing was attended by all nine judges of the constitution, namely Moh. Mahfud MD, Achmad Sodiki, Ahmad Fadlil Sumadi, Maria Farida Indrati, M.Akil Mochtar, Harjono, Muhammad Alim, and Hamdan Zoelva. Nine judges of the Constitution asked some questions to be answered by the government represented by Suyanto.
The first question posed by Akil Mochtar, who asked if the purpose of the international standard is an objective of education in Indonesia or international standards are complementary. Then, Hamdan Zoleva also asked the international standards of the country which proposed an international standard in the implementation of RSBI or SBI.
Judge Maria Farida asked why the Government in this case the Ministry of Education and Culture established the RSBI and SBI differences that make people who are unable to feel treated discriminatory. "Do we like the Dutch East Indies era which is education to discriminate against certain circles? This impact will be widespread, whether existing evaluation? "She asked in surprise.
Suyanto then answer the questions of the constitutional judges one by one. He replied that RSBI and SBI only complementary, so not all the schools in Indonesia there were thousands of targeted into RSBI and SBI. "The number of SBI RSBI or very little of all the schools in Indonesia there were thousands," said Suyanto.
The existence of RSBI and SBI has a philosophy, which does not inhibit the rapid and do not also leave that had to be helped. That way, students who have high ability or in other words, smart, has a more appropriate place to learn that in RSBI or SBI. As for the mediocre or less learners, they are also still available in other public schools. "It is also to prevent the students ran to school abroad to look for ‘challenge’ to learn more again. But, that does not mean RSBI and BSI is expensive, there really is free as in Surabaya and Nunukan, "said Suyanto. (Yusti Nurul Agustin / mh/Yazid.tr)
