Nur Yahman-Aris Isnandar (Nuranis), candidates regent / deputy regional head elections of Jepara, Central Java province, asking the Court ordered the Election Commission (KPU) Jepara perform repeated voting in all polling stations on Jepara Regency.

"Ordered to the Respondent implement the re-voting in all polling stations as Jepara district," said Heru Widodo, Nuranis’ attorney when reading the subject application (petition) in the trial in the Constitutional Court (MK), Tuesday (21/02/2012) afternoon.

Trial with the preliminary agenda was case Number 5/PHPU.DX/2012 District Election results. Nuranis filed objections to the official report issued by the Respondent’s General Elections Commission (KPU), Jepara 6/BA/II/2012 Number of Vote Count Result Recapitulation of Regent and Vice Regent Election Year 2012, dated February 4, 2012. In the attachment to the minutes, the KPU Jepara set of votes for each candidate: Pet-Ahmad Marzuqi Subroto (number 1) obtained 222 213 votes; pair Kaeron Syariefudin-Ahmad Ja’far (number 2) 15 926 votes; partner Nur Yahman -Aris Isnandar (number 3) 189 150 votes, and the couple Yuli Nugroho-Din Amin (number 4) 95 699 votes.

According to Heru Widodo, the determination of the recapitulation is not legally valid. For vote-mate Ahmad Marzuqi Subroto (Mabrur) obtained through unlawful means, or at least accompanied by a severe misuse of authority by the KPU Jepara either individually or jointly with spouse Mabrur. Heru suggests the occurrence of fraud and serious violations that are structured, systematic and massive, so the favorable vote Mabrur partner. Instead, the couple Nuranis is the most disadvantaged by the actions of fraud and breach. "Election process conducted by the Respondent was preceded by a variety of offenses, whether committed by the Related Party as the incumbent candidate and Respondent as providers," said Heru.

Heru postulated, violations committed by the incumbent candidate with the involvement of Civil Society of the Village (PPD) Jepara.  Completion of the event, the village chief (senior) divided the money Rp. 100,000, and for village officials Rp. 50,000. Through PPD and village officials, Mabrur distribute stickers to villagers. "For officials (village head) was given the money as much as 1 million operations per village," said Heru.

Meanwhile, the violations committed by KPU Jepara, the argument Heru, among others, the change in voters list (DPT) is the change before and on the eve of the vote. "DPT Respondent established, the original is dated December 13, 2011.Then, on the pretext of the addition of a list of voters who have not entered, then made a decision in a letter dated January 28, 2012, and the day on January 29, the Respondent is making a decision on additional DPT is not known by us as a couple candidates for election, "said Heru postulated.

In addition, the couple also argues Conscience violations committed by the KPU Jepara printing of ballots exceed the demand. On the other hand, there are 11 districts would be a shortage of ballot papers.

Then, the offenses committed by officers KPPS. At the opening of the polling station, the officer gave a briefing on the procedure for voting to the voter with the instruction with the Java language: "Nek nyoblos, Siji wae ojo loro, telu, opo papat, mangkeh batal" (If vote, just one, not two, three or four, later it can be canceled).

Before concluding the hearing, the panel advised the applicant to prepare a petition supporting evidence. The next trial will be held on next Thursday. (Rosihin Nur Ana / mh/Yazid.tr)
