Court General Secretary Janedjri M. Gaffar brief the Outstanding Elementary teachers throughout Indonesia at Grand Hotel Sahid Jaya, Jakarta, Sunday (14 / 8)

Teachers role are to build a culture of conscious constitutional. Understanding constitutional awareness is not merely knowing and understanding the constitution, but also implement the constitution itself. This is not the responsibility of the Constitutional Court (MK) alone, but also the responsibility of us all, including teachers.

In order to establish a constitutional culture that is conscious, MK activities among them through dialogue meeting with the various elements of society. For example, it is done to educators, political parties, civic organizations, religious organizations, institutions and other countries.

"In addition, each year the Constitutional Court gives grace to the Citizenship Education teachers who excel, in cooperation with the Ministry of National Education and Religious Affairs Ministry," said General Secretary MK Janedjri M. Gaffar kepara elementary teachers all over Indonesia at Grand Hotel Sahid Jaya, Jakarta on Sunday (14 / 8).

Janedjri said, teachers play an important role as change agents to spread the culture of constitutional to their students. The large numbers of students are very potential for building a culture of conscious constitutional. Moreover, students are expected to become future leaders and future generations as well as conscious constitutional.

"Indonesia is the 1945 Constitution, binding on all citizens and all state officials. Since the constitution is binding, it would require the involvement of teachers to take responsibility for their students understand the constitution, "explained Janedjri.

Janedjri is said, the constitution has superior properties as well as basic law because it is the supreme law of the binding based on the supreme power or sovereignty principle adopted in a country. In the position as the legal basis of state and supreme law, the constitution is a guideline and it holds together all elements of the state in maintaining the life of the country.

Furthermore Janedjri explained, the current 1945 Constitution is the result of changes in prevailing before the 1945 Constitution. Changes made as many as four stages in 1999-2002, as the political reform which necessitates constitutional reform in 1998 after the new order of government.

One of the background to the change or amendment to the Constitution 145 is the ‘highest authority in the hands of the Assembly’. So after changing the 1945 Constitution, in Article 1 Paragraph (2) states that ‘sovereignty is vested in the people and carried out according to the Constitution’. Thus, it is no longer fully implemented by the Assembly, as contained in the 1945 Constitution before the amendment.

According to the 1945 Constitution, a state institution distinguished by its function and its role as stipulated in the 1945 Constitution. No longer had the highest institution or institutions qualifying as high-power functionally separated horizontally as far as the powers prescribed by the 1945 Constitution.

On that occasion, Janedjri tells the story of struggling of a teacher from Banyuwangi for education budget in the state budget. In 2006 the teacher to come to Court to apply for judicial review the State Budget Law related to the amount of education budget 9.1 percent. Though the 1945 education budget confirms at least be 20 and a message from the state budget or the budget. Apparently the teacher did not struggle in vain; in 2008 the national education budget was changed to 20 percent. (Nano Tresna A. / mh/Yazid.tr)
