Chairman of Constitutional Court (MK), Moh. Mahfud MD, congratulated the participants on "Education and Training of Procedural Law on the Constitutional Court" on the 4th Floor of the Court Building, Jakarta, Monday (20/6).
Knowledge and skills role in procedural law of the Constitutional Court (MK) is indispensable. It is not only required by the constitutional justices and employees of the Constitutional Court, but also the litigants in the Court. Therefore, the Education of Procedural Law of the Constitutional Court should be given to each college. This was stated by Chairman of the Constitutional Court (MK), Moh. Mahfud MD during the opening of "Education and Training of Procedural Law on the Court", Monday (20/6).
On the occasion, it also attended the former of Constitutional Court Justice, I Dewa Gede Palguna, Secretary General of the Constitutional Court Janedjri M. Gaffar, and approximately 101 legal educators from across the region in Indonesia. According to Mahfud, procedural law today is still growing towards maturity. In Constitutional Court Act, it does not provide concise rules. Therefore, the procedural law of the Court is set in the Constitutional Court rules."Until now, this is still the authority of the Constitutional Court that has not been implemented, namely the dissolution of political parties and impeachment," said Mahfud.
Furthermore, Mahfud said the existence of the Constitutional Court has sprouted new spirit on law in Indonesia, especially on constitutional law. Lately, he argues, if we follow the news in the mass media, many people who say there are still two legal institutions can be expected for the development of law and fighting corruption, that is Constitutional Court and Corruption Eradication Commission (KPK)."But now, many people say only Constitutional Court, because the Commission considered insecure in the work," he stated.
In addition to highlighting the existence of the Constitutional Court in its civility, Mahfud also touched on constitutional law before the Constitutional Court stands. According to him, studying constitutional law is not the primary choice. "Usually to choose constitutional law taken by activists who are interest in that field. That was not all activists. Many of those choose criminal law or civil law. Therefore, the constitutional law always took a handful of students. Now it is growing, "said Mahfud.
More importantly, drastic changes are not only due to changes in the 1945 Constitution in 1999-2002, but also after the Constitutional Court acting since the founding, in August 2003. Mahfud felt starting in 2005; there was the development of state constitutional law. Constitution is interesting in campus. "Therefore, I cannot imagine if it is not on the right way to build the Constitutional Court, the agency would like other institutions that do not have fangs and just deal with matters of formality, as stated in the rules of law," explained Mahfud .
According to Mahfud, the Court today has begun building a judicial authority, accountable, transparent, fast, and logic to control. Therefore, education and legal training becomes necessary to understand the Constitutional Court."Especially now many colleges teach the procedural law of the Constitutional Court as a subject, so that the event is expected to teachers not only know the normative law of procedure of the Constitutional Court, but it will be enriched with developments in the practice of the Court," Mahfud said.
The Material
The event will be held from 20 to 23 June 2011 contains a material given by the speaker of the constitutional judge, a former constitutional judge, and legal experts. They will deliver the Constitution of 1945 and the Constitutional Court in constitutional system of Indonesia. It is also the theory and the Supremacy of the Constitution, Maruarar Siahaan will give the Procedural Law in Dispute upon Authority of the State Institutions (SKLN), Kasianur Sidauruk will give judicial administration, while Maria Farida Indrati will give proceedings in judicial review against the Constitution.
