Election Commission of West Seram Consider Petition Past Deadline

Jakarta, MKOnline - General Elections Commission (KPU) of West Seram regency (SBB), Maluku Province, in their response, stating that the petition filed by La Kadir-Souhaly Roberth pair to the Constitutional Court (MK) has passed the deadline. "This is, in accordance to the Constitutional Court Regulation Number 15 Year 2008," said Antoni Hatane, SBB KPU attorney in the hearing at the Constitutional Court (MK), Thursday (06/09/2011).

Furthermore, the SBB Commission through Antoni in response stated the legal subject of the petition was misdirected. According to the SBB Election Commission, the petition was not related to the election dispute. "Because the petition is not in question about vote counts,"said Antoni.

In the main substance (Petitum) to the Court, the SBB Election Commission demanded the petition of La Kadir-Souhaly Roberth pair unacceptable. "In Petitum, to accept the Respondent's exception entirely. To declare Petitioners’ petition, unacceptable, "pleaded Antoni.

In addition, in the the SBB Petitum Election Commission demanded the Court to state information of the Related Party II pair M. Yasin Payapo-La Nurdin (Yanuar) can not be accepted. "In the main petition, to reject the petition of of the Related Party II for its entirety or to state information of the Related Party II unacceptable," pleaded Antoni.

Meanwhile, in line with the Election Commission the SBB, the Related Party I Jacobis Puttileihalat-pair Mohammad Husni (Bob-Husni) through its legal counsel, Latif Lahane, in his statement also said that La Kadir-Souhaly Roberth petition to the Court had passed the provisions of 3 days deadline for submission of a petition. Bob-Husni also considered the Petition vague according to the law (obscuure libel), because the Petitioners did not question the right results of vote counting according to the version of the Petitioner and the vote counting according to Respondent's version.

Couple Hosni Bob-strongly refused the arguments put forward by La Kadir in the main-Souhaly Roberth petition. Among other things, argument about the mass mobilization of civil servants, and money politics. Instead, according to Bob-Husni, money politicsargument is intentionally designed for divert attention on the involvement of La Kadir-Souhaly Roberth in money politics. "Petitioners' argument is intentionally made for divert the involvement of the Petitioners who committed money politics in some villages in West Seram regency, on the eve of the voting,"said Latif Lahane, legal counsel Bob Husni.

Panel Session for case number 62/PHPU.D-IX/2011 on Election Result of Dispute over Regional Head and Deputy Head of West Seram regency was carried out by the Panel of Justices chaired by Moh. Mahfud MD, accompanied by Maria Farida Indrati and Anwar Usman. 

After hearing the answer from the SBB Election Commission, information of the Related Party I and Related Party II, the the next hearing session is substantiation. The Petitioners Witness named Abdul Malik Tubaka explained about the existence of DPT inflation in the Koloik Village Kairatu District. Former Members of Central Maluku Parliament also explained the inclusion of 3 villages in SBB General Election. Yet according to witnesses, the 3 villages falls within the Central Maluku Regency.
