Jakarta, MKOnline - Without a sound reason, Fahri Alamudie was absent from a session in the Constitutional Court (The Court) held on Monday (11/4). The session scheduled to begin at 13.00 WIB was postponed for a while as the Petitioner had not shown up. The Panel of Justices finally began the session at 13.24 WIB; but since the Petitioner still did not appear for the verification of revised petition, the Board of Justices closed the session at 13.26 WIB.
“Because the Petitioners for case 22/PUU-IX/2011 does not come, then I announce this session is closed,” said the Chairman of Panel Achmad Sodiki as he slammed the gavel three times as a closing sign.
As in the initial session (18/3), The Court examined the review of Act 20/20000 on the Amendment of Act 21/1997 about Custom on Acquisition of Land and Property Rights filed by Fahri Alamudie who at that time came without a counsel. He claimed that his constitutional right was harmed by the enactment of Article 2 paragraph (2) letter b of the Act which was considerd to be in contradiction with Article 34 paragraph (3) of the 1945 Constitution.
Fahri claimed that upon the transaction over a piece of land, two taxes were imposed on him. According to him, customs on acquisition of Land and Property right in giving a new right was not a legal event as arranged in the mentioned Act as it was the government obligation because the government earned a yearly income in form of land and property right.
